Ord 086-84 8/7/1984 ORDINANCE NO. f _ui/ ORDINANCE ALLOWING TEMPORARY BARRICADING OF AN UNIMPROVED PORTION OF PAWHUSKA DRIVE FOR THE PURPOSE OF PREVENTING UNLAWFUL DUMPING UPON CERTAIN UNIMPROVED PORTIONS OF WEST INDIAN HEIGHTS SUBDIVISION, CITY OF WICHITA FALLS , TEXAS. WHEREAS, the Planning Department has recommended that Gale A. Gaynor be allowed to barricade an unimproved portion of Pawhuska Drive, hereinafter described; and, WHEREAS, the City Council deems it advisable and in the public interest to allow said temporary barricade to prevent dumping by persons unknown onto the unimproved property lying directly behind the proposed barricade . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Gale A. Gaynor shall be allowed to barricade the unimproved portion of Pawhuska Drive, more specifically described as follows: BEGINNING at the northeast corner of Lot 1, Block F, West Indian Heights, an addition to the City of Wichita Falls, Texas, THENCE north 54 degrees 30 minutes west, 50 feet along the southerly line of Pawhuska Drive to the beginning point of this description. THENCE north 35 degrees, 30 minutes east, 60 feet perpendicular to Pawhuska Drive, to the northerly line of Pawhuska and the end of this description. under the condition that the portion barricaded shall remain subject to all easements heretofore granted upon all such barricaded property and that Gale A. Gaynor shall provide a swinging gate of sufficient length as to provide easy access to all entities having right of access to any property barricaded thereby for the purpose of going upon said land for lawful purposes and so long as any barricade shall be of "hurricane" fencing to provide ready visibility to any land thereby barricaded and that the temporary barricade shall be totally dismantled at the expense of Gale A. Gaynor upon 30 days written request by the City of Wichita Falls to remove same. PASSED AND APPROVED this the 7th day of August, 1984 .
