Ord 093-84 8/7/1984 ORDINANCE NO. ORDINANCE CLOSING HEARING AND FINDING A CERTAIN BUILDING AND/OR STRUCTURE TO BE DANGEROUS, AND REQUIRING IMMEDIATE DEMOLITION TO PRESERVE LIFE AND PROPERTY IN THE CITY OF WICHITA FALLS; ORDERING IMMEDIATE DEMOLITION OF SAID BUILDING AND/OR STRUCTURE; DECLARING AN EMERGENCY. WHEREAS, the Code Enforcement Officers of the City of Wichita Falls, acting under the provision of Article III of Chapter 7 of the Code of Ordinances of the City of Wichita Falls, notified by personal service to the property owner of the property shown that the building or buildings on the premises had been classified as dangerous, and that immediate demolition is necessary to preserve life and property in the City of Wichita Falls . OWNER PROPERTY ADDRESS & LEGAL DESCRIPTION Lester Robinson 401 N . Eastside Drive, Lots 9 and 10, less Right-of-Way, Block 73, Original Townsite . WHEREAS, such building or structure was found by City Code Enforcement Officers to be a dangerous building or structure requiring immediate demolition to preserve life and property in the City of Wichita Falls; and, WHEREAS, the above-listed property owner has been notified by personal service of the time and date of the Public Hearing for the above-named property owner to appear before the City Council to show cause why such building or structure should not be demolished; and said Public Hearing was had and held at the time and place fixed therefore, to-wit: on the 7th day of August, 1984 , at o'clock 4r .m. , in the Council Chambers in the City of Wichita Falls, Texas, and at such Public Hearing the following protests and objections were made, to-wit: PROTESTED THAT PROTESTED THAT PROTESTED THAT PROTESTED THAT PROTESTED THAT and said hearing was continued until all desiring to be heard were given full and fair opportunity to be heard and the City Council of the City of Wichita Falls, Texas, having fully considered all property matters, is of the opinion that the said hearing should be closed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS , TEXAS, THAT: Said hearing be and the same is hereby closed, and the said protests and objections and any and all other protest objections, whether enumerated or not, be and the same are hereby overruled. From the evidence presented in the aforementioned Public Hearing by property owners appearing and Code Enforcement Officers of the City of Wichita Falls, the building and/or structure at the location listed above with the corresponding property owner is found to be a dangerous building as defined in said Article III and constitutes an immediate threat to life and property in the City of Wichita Falls; and it is therefore ordered that the building and/or structure at the location listed above be immediately demolished under the supervision of the City of Wichita Falls. The fact that demolition of dangerous buildings is being delayed pending the taking effect of this ordinance creates an emergency for the immediate preservation of the public business place, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and is accordingly so ordained.
