ORDINANCE AMENDING SUBSECTION (D) OF SECTION 10
OF APPENDIX A (COMPREHENSIVE SUBDIVISION ORDINANCE)
OF THE CODE OF ORDINANCES TO ALLOW DISCRETION IN
CONTRACTING FOR WORK IN WHICH THE CITY WILL
CONTRIBUTE A PORTION OF THE COST .
WHEREAS, a developer (subdivider) is responsible for all
design, engineering, material, construction and installation costs
of all improvements required by the Subdivision Ordinance; and,
WHEREAS , the city may at times require a developer to install
utility facilities at a larger capacity than required to serve
the developer's subdivision; and,
WHEREAS, the city will pay for the difference between the
cost of the larger capacity and the capacity required to serve
the subdivision; and,
WHEREAS, the Subdivision Ordinance currently requires such
jointly-funded projects to be contracted by the city; and,
WHEREAS , there may be cases wherein it would be more advanta-
geous for all parties to allow the developer to contract for the
jointly-funded project; and,
WHEREAS , this can be done by establishing certain requirements
to meet state and local laws.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS , TEXAS, THAT:
Subsection (D) of Section 10 of Appendix A (Comprehensive
Subdivision Ordinance) of the Code of Ordinances is hereby amended
to read as follows:
" (D) Should the Director of Public Utilities require the
installation of water and sewer facilities of a larger capacity
than necessary to provide adequate water or sewer service to the
subdivider ' s property, the difference between the cost of such
larger facilities and the size facility required to serve the
subdivision will be paid for by the City of Wichita Falls . Such
facilities may be constructed under contract awarded by the City,
with a predetermined rate for the developer' s share to be deposited
with the City prior to the award of the contract. At the option
of the city, such facilities may be constructed under a contract
awarded by the developer, provided city and state requirements
are met.
Under either system, the prorata share of the cost to be
borne by the developer shall include all material, construction,
and installation cost for the size facility adequate to serve the
developer' s property . For the purposes of this article, the
minimum size line required to serve a subdivision shall not be
less than eight (8) inch water and/or sewer. "
