Ord 130-84 11/6/1984 ORDINANCE NO. /1(49- ORDINANCE CLOSING HEARING AND FINDING CERTAIN BUILDINGS AND/OR STRUCTURES TO BE DANGEROUS: COMMANDING PROPERTY OWNERS TO REPAIR OR DEMOLISH SAID BUILDINGS AND/OR STRUCTURES WITHIN THIRTY (30) DAYS OF THE DATE OF THIS ORDINANCE AND DECLARING AN EMERGENCY. WHEREAS, the Building Inspector of the City of Wichita Falls, Acting under the provision of Article III of the Chapter 7 of the Code of Ordinances of the City of Wichita Falls, notified in writing by certified mail the following list of property owners of the property shown that the building or buildings on the premises had been classified as a dangerous building and that certain corrections were needed to be made or the building demolished. Minor 4172 Juarez, E 2 Lot 10, Blk 16 511 Welch Bateson Addition, House Wichita Falls, TX 76301 WHEREAS, the above listed property owners and all other persons having an interest in the property have been notified by certified mail by the Building Inspector of the time and date of the Public Hearing for the above named property owners to appear before the City Council to show cause why such building or struc- ture should not be repaired or demolished in accordance with the State of Particulars set forth in the Building Inspector's notice; and said Public Hearing was had and held at the time and place fixed therefore, to wit, on the 6th: day of November at 8:30 a.m. in the Council Chambers in the City of Wichita Falls, Texas, and at such Public Hearing the following protests and objections were made to wit: Clarence Yates, 2607 Holliday, PROTESTED THAT he has to do all the work himself. Barbara Minor White, 511 Welch, PROTESTED THAT the property is occupied, and the tenants are fixing it up. and 816 Chance, Lee Kelley, 715 and 715a Sullivan, 306 Deggs,/ PRDTESI ED THAT some demands are being made that he cannot possibly comply with. PROTESTED THAT PROTESTED THAT and said Hearing was continued until all desiring to be heard were given full and fair opportunity to be heard and the City Council of the City of Wichita Falls having fully considered all property matters, is of the opinion that the said Hearing should be closed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Said hearing be and the same is hereby closed', and the said protests and objections, and any and all other protest objections, whether enumerated or not, be and the same are hereby overruled. From the evidence presented in the aforementioned Public Hearing by property owners appearing and the Building Inspector of the City of Wichita Falls, the building and/or structure at the locatioc listed above with the corresponding .4 property owner is found to be a dangerous building as defined in said Article III and the property owners listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls, are hereby commanded to repair or demolish the building and/or structure in accordance with the State of Particulars set forth in the Building Inspector's notice. The property owner listed or any other person having an interest in said building as shown by the tax records of the City of Wichita Falls is further commanded to repair or demolish in accordance with the State of Particulars set forth in the Building Inspector's notice within thirty (30) days from the date of this Ordinance. If, within 30 days from the date of this ordinance any such building has not be repaired or demolished, it shall be demolished or removed at the expense of the City by the City or its contractor, and the net cost for demolition or removal shall'_ be charged to the owners of the property and assessed on the land on which the building stood. The fact that the repair or demolition of dangerous buildings is being delayed pending the taking effect of this Ordinance creates an emergency for the immediate preservation of the public business place, property, health, safety and general welfare of the public which requires that this Ordinance shall be- come effective from and after the date of its passage and is accordingly so ordained.
