ORDINANCE WAIVING SECTIONS 27-29 AND 27-30 OF
THE CODE OF ORDINANCES CONCERNING FOUR FOOT
OBSTRUCTION-FREE SIDEWALK IN REGARDS TO PROPERTY
LOCATED ON THE INSIDE OF THE LOOP OF PLAZA PARKWAY
AND MAPLEWOOD AND DESCRIBED AS LOT 1, BLOCK 20,
MIDWESTERN PARK, SECTION 1 .
WHEREAS, Robert Seabury has requested permission to construct
a sprinkling system in the public parkway on the inside of the
loop of Plaza Parkway and Maplewood, otherwise known as Lot 1,
Block 20, Midwestern Park, Section 1.
WHEREAS, Robert Seabury has requested permission to plant
grass on the parkway on the inside of the loop of Plaza Parkway
and Maplewood; and,
WHEREAS , the developer, Robert Seabury, agrees to maintain the
sprinkling system and grass planting located on the inside of the
loop of Plaza Parkway and Maplewwod and agrees to record this
document as a requirement for future owners to maintain same in
perpetuity if he does not have to install a sidewalk, and to furnish
proof of such recordation to the City within thirty (30) days of
the waiver granted herein; and,
WHEREAS, the City Council finds the circumstances exceptional
and that the requirements of Sections 27-29 and 27-30 of the Code
of Ordinances concerning that sidewalk should be waived.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS , THAT:
The requirements of Section 27-29 and 27-30 of the Code of
Ordinances concerning four-foot wide obstruction-free sidewalk
be waived and that Robert Seabury be allowed to construct a
sprinkling system and grass in the area between the property line
and the curb on Lot 1, Block 20, Miwestern Park, Section 1, in
lieu of construction of a sidewalk.
