Ord 137-84 11/20/1984 ORDINANCE NO. a/7 (Al ORDINANCE TO AMEND SECTION 10, PARAGRAPH (F) , OF APPENDIX A (SUBDIVISIONS) OF THE CODE OF ORDINANCES WHEREAS, the Subdivision Ordinance requires a developer to provide water and sewer utility service to a new subdivision; WHEREAS, the ordinance further provides that all water and sewer lines constructed or installed pursuant to the subdivision ordinance shall, when completed and accepted, become the property of the City; WHEREAS, the City then becomes responsible for the maintenance of the dedicated utility system; and, WHEREAS, it is normal and proper for the City to require the developer of the subdivision to provide maintenance on the utility systems for a period of one year after installation is complete; WHEREAS, the subdivision ordinance, as currently written, does not explicitly require the developer to provide a maintenance bond for the one year period subsequent to completion of the utility system; and, WHEREAS, the Council finds it desirable that such provision be included in the Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Section 10 (F) of Appendix A (Subdivisions) of the Code of Ordinances is amended to read as follows: "(F) All sewer and water lines constructed or installed pursuant to the provisions of this ordinance shall, when completed and accepted by the Director of Public Utilities, become the property of the City, free and clear of all encumbrances. The subdivider shall provide a maintenance bond on the sewer and water lines for a period of one year after the date on which the City accepts the property. Each and every contract entered into between a subdivider and a contractor for the installation of sewer or water lines pursuant to the provisions of this ordinance shall recite therein the provisions of this sub-section."
