ORDINANCE ACCEPTING CONSTRUCTION AND
AUTHORIZING FINAL PAYMENT TO THE
CONTRACTOR FOR THE BRENDA HURSH
SOUTHWINDS DRAINAGE PROJECT - 1982
CAPITAL IMPROVEMENTS PROGRAM 55-625
AND 55-628
WHEREAS, the City of Wichita Falls and Ralph Garza
Construction Company entered into a contract dated October 18, 1983,
for the construction of the 1982 Capital Improvements Program 55-626
and 55-628;
WHEREAS, such project has been completed in accordance with
the plans and specifications; and,
WHEREAS, such contract was a unit price contract, and the
estimated cost based on estimated quantities was $505,515.92; however,
on the basis of the actual quantities used in the construction, the total
contract price is $473,742.27, of which $445,079.34 has been paid to the
contractor, leaving a balance due of $28,662.93.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The construction of such project is accepted by the City of
Wichita Falls; and the City Manager is authorized and directed to pay to
the contractor the amount due as set out above.
