RESOLUTION NO. 89-90
RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A RELEASE OF A DRAINAGE EASEMENT TO
THE WICHITA FALLS INDEPENDENT SCHOOL
DISTRICT.
WHEREAS, on September 18, 1985, the Board of Trustees of the
Wichita Falls Independent School District conveyed a 9.62 acre
drainage easement to the City of Wichita Falls for the Holliday
Creek Project; and,
WHEREAS, since that time the construction plans have been
changed as federal funding has been acquired for this project;
and,
WHEREAS, it was agreed that the City of Wichita Falls would
release the original easement and a new easement will be acquired
to meet the Corps of Engineers right-of-way plans for Phase III
of the Holliday Creek Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to execute and deliver
a release of the drainage easement recorded in Volume 1416, Page
22 of the Wichita County deed records and described as follows:
A tract of land out of the Wichita Falls Independent
School District Addition as filed May 29, 1974, in the
plat records of Wichita County, Texas, and described by
metes and bounds as follows:
BEGINNING at the Southeast corner of the Wichita Falls
Independent School District Addition;
THENCE North 59° 25 ' West 700 feet;
THENCE North 65° 05 minutes East 1,470 feet, more or
less, to a point in the East line of said Wichita Falls
Independent School District Addition;
THENCE South 37° 46 ' East to the Place of Beginning and
containing 9. 62 acres of land, more or less.
PASSED AND APPROVED this the 15th day of May, 1990.
