RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A
QUIT CLAIM DEED TO THE ESTATE OF ADDIE BANDY,
DECEASED, OF ANY INTEREST OWNED BY THE CITY
TO AN IRRIGATION CANAL EASEMENT ACROSS A
PORTION OF BLOCK 12, KEMP AND NEWBY
SUBDIVISION.
WHEREAS, the City Council of the City of Wichita Falls,
Texas, has received a request to Quit Claim any interest owned by
the City in an irrigation canal located on a portion of Block 12,
Kemp & Newby Subdivision; and,
WHEREAS, such canal is no longer in use, and the City
Council of the City of Wichita Falls is of the opinion that the
execution of a Quit Claim Deed is in the public interest and
desirable.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Mayor of the City of Wichita Falls, Texas,
be and is hereby authorized to execute on behalf of the City of
Wichita Falls, a Quit Claim Deed to the Estate of Addie Bandy,
Deceased, for a 60 foot wide strip of property previously used as
a canal across a portion of Block 12, Kemp and Newby Subdivision.
PASSED AND APPROVED this the 6th day of March, 1990.

QUIT CLAIM DEED

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA
THAT the City of Wichita Falls, Texas, a municipal
corporation, hereinafter called Grantor, acting by and through
its duly authorized Mayor, for and in consideration of the sum of
One ( $1.00) Dollar in hand paid by the Estate of Addie Bandy,
Deceased, hereinafter called Grantee, the receipt of which is
herein acknowledged, has granted, sold, conveyed, released, and
forever quit claims unto the said Grantee, all its right, title,
and interest in and to the following described real property
situated in Wichita County, Texas, to-wit:
BEGINNING at the Northwest corner of Lot 1, Block
12, Kemp & Newby Subdivision, J.A. Scott Survey
No. 11, A-299, according to plat recorded in
Volume 25, Page 234 , Wichita County Plat Records;
THENCE South 37° 57 ' West 190. 25 feet to the
South line of Block 12, a point 417 . 0 feet West
of its Southeast corner;
THENCE West 5. 0 feet to the Southwest corner of
this tract;
THENCE North 90. 6 feet;
THENCE North 37° 57 ' East 75 . 3 feet to the South
line of East Scott Avenue;
THENCE with the South line of East Scott, East
75.7 feet to the Place of Beginning and
containing 0. 19 acre of land, more or less.
TO HAVE AND TO HOLD the above described premises, together
with all and singular the appurtenances thereto, except as
otherwise reserved, in any way belonging unto the said Grantee,
its successors and assigns, as above provided.
Grantor further acknowledges and confesses that this
conveyance is made pursuant to the authority of Resolution Number
54-90 of the City of Wichita Falls, Texas, passed and approved
on the 6th day of March, 1990.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a
municipal corporation of Wichita County, Texas, has caused this
instrument to be executed by its Mayor, this the 6TH day of
March 1990.
