Res 141-90 8/14/1990RESOLUTION NO. 4#_p RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL CHARTER AMENDMENT ELECTION HELD IN THE CITY OF WICHITA FALLS, TEXAS, ON AUGUST 11, 1990. WHEREAS, at a special meeting of the City Council of the City of Wichita Falls, Texas, held in the Memorial Auditorium building on the /4L2/day of August, 1990, at which time a quorum was present, there came on to be considered the returns of the special charter amendment election held on the 11th day of August, 1990; and, WHEREAS, after canvassin g the returns of said election, it wap found to be duly and legally held in all respects, and that 6, 5:3g voters voted in said election, and that votes were cast as follows: PROPOSITION NO. 1: Yes OD No 4 .3o v PROPOSITION NO. 2: Yes J, L5G' No Dff NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: Said election was in all respects legally held in accordance with the laws of the State of Texas and the Charter and the ordinances of he City of Wichita Falls; that Pro Z.tion No. 1 was and the Charter amendment that Propositi No. 2 was iiLand the arter amendment PASSED AND APPROVED this the / 2/da - August, 1990. M Air"- O R ATTEST: City Clerk ORDINANCE NO. 47-4-h ORDINANCE OF THE CITY OF WICHITA FALLS CALLING FOR A SPECIAL ELECTION FOR AUGUST 11, 1990, TO SUBMIT PROPOSED AMENDMENTS TO THE CITY CHARTER OF THE CITY OF WICHITA FALLS; SETTING FORTH THE PROPOSED AMENDMENTS; PRESCRIBING THE FORM OF THE PROPOSITIONS; NAMING ELECTION OFFICIALS AND POLLING PLACES; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, in accordance with Section 9.004(a) of the Texas Local Government Code, the City Clerk has received a petition signed by the required number of qualified voters of the City calling for the submission of proposed charter amendments to the voters of the City of Wichita Falls; and, WHEREAS, the City Clerk, having received such petitions and determed that the requirements of Chapter 9 of the Texas Local Government Code have been satisfied and further has advised the City Council that the next authorized date to call a special election to consider the proposed charter amendments is August 11, 1990. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is hereby ordered that a special election is to be held in the City of Wichita Falls on August 11, 1990, for the purpose of submitting to the qualified voters the hereinafter described proposed charter amendments. Such election shall be held at the polling places named in Exhibit A attached hereto. Furthermore, the persons shown on Exhibit A are hereby appointed presiding election judges, alternative presiding election judges, central counting station judge, and ballot board judge. Each presiding election judge shall appointed not less than two nor more than four election clerks to assist them in the conduct of the election. Voters residing in the City limits of Wichita Falls, Texas, within the county precinct numbers shown on Exhibit A shall vote in the City polling places shown on such exhibit. SECTION 2. There shall be submitted at such special municipal election on August 11, 1990, the following measures as proposed amendments to the City Charter of the City of Wichita Falls: Measure No. 1 . That new Section No. 152 shall be added to the City Charter of the City of Wichita Falls to read as follows: Retirement Benefits. Section A. The City of Wichita Falls shall adopt the following retirement options to a maximum as provided by the Texas Municipal Retirement System, or its successor in function, for its police officers and other affected employees of the City of Wichita Falls, who are participants in the Texas Municipal Retirement System: A) Updated Service Credits to a Maximum Rate of 100%; B) Vesting after 10 years of Service; C) Retirement after 25 years of Service at any age; D) Annuity Increases of the CPI to a maximum of 70%; E) Supplemental Death Benefits fore Retirees and Employees; F) City Matching Ratio of 2 to 1. Section B. The City of Wichita Falls shall adopt the appropriate ordinance and file the required records with the Texas Municipal Retirement System, or its successor in function, in a timely manner such that the retirement options may be adopted by the City at the earliest statutorily-permitted time period. " Measure No. 2. That new Section No. 153 be added to the City Charter of the City of Wichita Falls, Texas, such section to read as follows: Minimum Staffing Levels of Police Department. Section A. The City of Wichita Falls shall adopt the following staffing levels of commissioned police officers: A) That effective October 1, 1991, the City of Wichita Falls will allot for a minimum staffing level of 165 commissioned police officers; B) That effective October 1, 1992, the City of Wichita Falls will allot for a minimum staffing level of 175 commissioned police officers; C) That effective October 1, 1993 , the City of Wichita Falls will allot for a minimum staffing level of 180 commissioned police officers. Section B. The City of Wichita Falls will also provide for the salaries, uniforms, equipment and supervisory rank as are needed in each of the phases. " 1 SECTION 3 . The proposed measures to amend the Charter of the City of Wichita Falls, as proposed in Section 2 of this ordinance, shall be submitted to the qualified voters at the special election on August 11, 1990, on the ballot and in the form of the following propositions. The numbers of the propositions shall correspond to the numbers of the measures and the words "YES" and "NO" shall be printed to the left of each proposition on the ballot: Proposition No. 1. Shall new Section 152 be added to the City Charter to provide for establishing municipal employee retirement benefits consisting of 100% Updated Service Credits; 10 year vesting; retirement after 25 years of service at any age; annuity increase of CPI to a maximum of 70%; supplemental death benefits for employees and retirees; and a City matching contribution level of 2 to 1. Proposition No. 2. Shall Section No. 153 be added to the City Charter to authorize minimum staffing levels of the Wichita Falls Police Department so as to require a minimum of 165 commissioned police officers by October 1, 1991; a minimum of 175 commissioned police officers by October 1, 1992; and a minimum of 180 commissioned police officers by October 1, 1993 .
