RESOLUTION DETERMINING NECESSITY FOR
ACQUISITION OF PROPERTY FOR THE EXTENSION OF
MAURINE STREET, APPROVING THE APPRAISALS,
SETTING JUST COMPENSATION, AND AUTHORIZING
PURCHASE OR CONDEMNATION.
WHEREAS, the State Department of Highways and Public
Transportation has completed the plans for the extension of
Maurine Street using the Option II alignment in accordance with
City Council Bill #251 of September 19, 1989; and,
WHEREAS, the appraisals have now been completed on the ten
parcels of real property required by these plans as well as one
additional parcel required by the City to extend the road to
Pleasant View Drive, and such appraisals have been reviewed by
the Property Administrator and by the Right-Of-Way Division ofPYYg
the local office of the State Department of Highways and Public
Transportation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of providing the
necessary right-of-way for the Maurine Street Extension Project.
SECTION 2. The legal descriptions of the parcels to be
acquired in fee simple title in the name of the State of Texas
are as follows:
Parcel #M-i
A 0.012 acre tract, out of a 35. 9 acre tract in the
E. Scurry Survey, A-481.
Parcel #M-2
A 0.031 acre tract out of a 0. 98 acre tract in the
E. Scurry Survey, A-481.
Parcel #M-3
A 0.036 acre tract out of a 1.607 acre tract in the
E. Scurry Survey, A-481.

A 0. 054 acre tract out of an 18.71 acre tract in the
E. Scurry Survey, A-481.
Parcel 1M-5
A 1. 028 acre tract out of a 12. 19 acre tract in the

A 0. 554 acre tract out of a 2.40 acre tract in the

The legal description of the parcel to be acquired as a
temporary construction easement in the name of the State of Texas
is as follows:

A 0.049 acre tract out of a 10.32 acre tract in the
E. Scurry Survey, A-481 and the D. Leona Survey,
A-176.
The above listed tracts being fully described by metes and
bounds in surveys provided to the City of Wichita Falls by the
State Department of Highways and Public Transportation.
The legal description of the parcel to be acquired in fee
simple title in the name of the City of Wichita Falls is as
follows:
Parcel #M-11 Tract I
A 1. 58 acre tract out of Block 1, Arrowhead
Industrial District, Tract "C" .
Parcel #M-11 Tract II
A 0. 09 acre tract out of Block 2, Arrowhead
Industrial District, Tract "C" .
The above listed parcels being fully described by metes and
bounds in surveys prepared by Biggs & Mathews, Inc. , on January
3, 1990.
SECTION 3 . The amount of just compensation for fee simple
title to the above described tracts is as follows:
M-1 $2,354.00 M-5 4,914.00 M-10 $17,235.00
M-2 7,109. 00 M-7 606.00 M-11 39,443.00
M-3 4,704.00 M-8 1,650.00
M-4 7,650.00 M-9 3 ,038.00
The amount of just compensation for a temporary construction
easement on Parcel #M-7 TCE is $29.00.
These amounts are also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise these tracts. The Property Administrator is
hereby authorized to acquire fee simple title in the name of the
State of Texas on Parcels #M-1, M-2, M-3, M-4, M-5, M-7, M-8, M-9
and M-10, and a temporary construction easement on Parcel #M-7
TCE, and fee title in the name of the City of Wichita Falls on
Parcel #M-11.
SECTION 4. In the event the Property Administrator is
unable to purchase the parcels for the appraised value, the City
Manager is authorized to increase the offer when, in his
judgment, it appears to be in the best interest of the City to do
so to save the cost of condemnation. If both parties are unable
to agree upon a value for the property, the City Attorney is
hereby authorized to institute condemnation proceedings to obtain
such property in the name of the City of Wichita Falls for the
extension of Maurine Street.
