RESOLUTION TO APPROVE NINTH AMENDMENT TO
WATER PURCHASE CONTRACT WITH DEAN DALE WATER
SUPPLY CORPORATION
WHEREAS, the City of Wichita Falls and Dean Dale Water
Supply Corporation entered a Water Purchase Contract on March 2 ,
1977 whereby the City of Wichita Falls provides treated water
through its distribution system to the Corporation;
WHEREAS, Section 1.8 of the contract limits the purchase of
water by the Corporation to 150, 000 gallons daily;
WHEREAS, growth in the Dean Dale area has increased the
demand for water, requiring Dean Dale to have a greater supply of
treated water to mix with its own well water to reduce the level
of nitrates served to its customers; and,
WHEREAS, the City of Wichita Falls has an adequate supply of
treated water to increase the amount sold to the Corporation.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The attached Ninth Amendment to the Water Purchase Contract
between the City of Wichita Falls and Dean Dale Water Supply
Corporation is hereby approved and the City Manager is authorized
to execute the amendment for the City.
