Res 202-90 12/6/1990RESOLUTION NO. dw5 -v RESOLUTION DETERMINING NECESSITY FOR ACQUISITION OF UTILITY EASEMENTS FOR THE MIDWESTERN PARKWAY PROJECT, APPROVING THE APPRAISALS, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, it has been determined that the City of Wichita Falls must acquire two utility easements for the relocation of water and electrical lines on Midwestern Parkway; and, WHEREAS, appraisals have been completed on the easements and have been reviewed by the Property Administrator. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire the hereinafter described property located in Wichita Falls, Wichita County, Texas, for the purpose of relocating water and electrical lines on Midwestern Parkway. SECTION 2. The legal descriptions of the easements to be acquired are as follows: Parcel #MP-1(U) A 0. 104 acre tract (4, 530 square feet) , more or less, out of a 2. 60 acre tract in the T. J. English Survey, Abstract No. 354, and a 1. 16 acre tract out of the J. M. English Survey No. 355, and being part of Lots 1 and 2, Block 21 , Midwestern Parkway Addition. Parcel #MP-2(U) A 0 . 010 acre tract ( 436 square feet) , more or less, out of a 1. 013 acre tract in the T. J. English Survey, Abstract No. 355 , and being part of Lot 6, Eureka Plaza Addition. SECTION 3 . The amount of just compensation for the utility easements to be acquired are as follows: MP-1(U) $13 , 590. 00 MP-2(U) $1,090. 00 These amounts are also the fair market value determined by Henderson Appraisal and Consultants, who were employed by the City to appraise the tracts. SECTION 4 . In the event the Property Administrator is unable to purchase the parcels for the appraised value, the City Manager is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Attorney is hereby authorized to institute condemnation proceedings to obtain such property in the name of the City of Wichita Falls for utility easements for the Midwestern Parkway Project.
