ORDINANCE WAIVING SECTION 27-29 OF THE CODE OF
ORDINANCES CONCERNING SIDEWALK REQUIREMENTS
ALONG GALVESTON STREET ON COMMERCIAL PROPERTY
HAVING A STREET ADDRESS OF 2108 HOLLIDAY AND
DESCRIBED AS BLOCK B , LOT 25-A, WYATT SOUTHSIDE
ADDITION.
WHEREAS, Ray Townsend has requested that the requirement
that sidewalks be constructed on all streets abutting a commer-
cial or industrial lot be waived; and,
WHEREAS, there are no other sidewalks on either side of the
street in that particular block of Galveston Street; and,
WHEREAS, the sidewalk will never be connected as it serves
the rear of the residences that front McGregor Street; and,
WHEREAS, the staff recommends that the waiver be granted
if the property owner agrees to plant three 2-1/2" caliper trees
in the public right-of-way and to replace and maintain same as
necessary and to record this document as a requirement for future
owners to maintain and to replace the trees if necessary in
perpetuity, and to furnish proof of recordation to the City
within thirty (30) days of the waiver granted herein; and,
WHEREAS , the City Council finds the circumstances exceptional
and that the requirements of Section 27-29 of the Code of
Ordinances concerning the sidewalk should be waived.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The requirements of Section 27-29 of the Code of Ordinances
requiring a sidewalk when constructing or remodeling buildings
be waived and that Ray Townsend plant and maintain three 2-1/2"
caliper trees in the public right-of-way in lieu of the sidewalk.
