RESOLUTION DETERMINING NECESSITY FOR
ACQUISITION OF A UTILITY EASEMENT FOR THE
RIVER ROAD WASTEWATER PROJECT, APPROVING THE
APPRAISAL, SETTING JUST COMPENSATION, AND
AUTHORIZING PURCHASE OR CONDEMNATION.
WHEREAS, the City of Wichita Falls has plans to make
numerous improvements to the River Road Wastewater Treatment
Plant and to install approximately two miles of sewer line along
Holliday Creek from East Scott to a new lift at the River Road
Plant; and,
WHEREAS, as part of this project, a permanent utility
easement and a temporary construction easement are required to
provide right --of -way for the gravity line from Lift Station 418
to Lift Station *l; and,
WHEREAS, an appraisal has been completed on the tract and is
now on file in the Property Management Office.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of accommodating a
new gravity sewer line.
SECTION 2. The legal descriptions of the tracts to be
acquired are as follows:
Permanent Utility Easement
A .38 acre tract out of the J.A. Scott Survey No.
14, Abstract 304.
Temporary Construction Easement
A 0.9 acre tract out of the J. A. Scott Survey
No. 14, Abstract 304.
Both tracts being fully described by metes and
bounds from a field survey performed by Corlett,
Probst & Boyd, Inc.

SECTION 3. The amount of just compensation for the
permanent easement is $152.00 and the temporary construction
easement is $45.00. These amounts are also the fair market value
determined by Henderson Appraisal and Consultants, who were
employed by the City to appraise these tracts.
SECTION 4. In the event the Property Administrator is
unable to purchase the parcels for the appraised value, the City
Manager is authorized to increase the offer when, in his
judgment, it appears to be in the best interest of the City to do
so to save the cost of condemnation. if both parties are unable
to agree upon a value for the property, the City Attorney is
hereby authorized to institute condemnation proceedings to obtain
such property in the name of the City of Wichita Falls for the
River Road Wastewater Treatment and 42 11/48" Interceptor Line
Project.
