RESOLUTION DETERMINING NECESSITY FOR
ACQUISITION OF EASEMENTS FOR LIFT STATION #8,
APPROVING THE APPRAISALS, SETTING JUST
COMPENSATION, AND AUTHORIZING PURCHASE OR
CONDEMNATION.
WHEREAS, the City Council authorized the acquisition of a
2,265 square foot easement on Lot 7, Block 70, Faith Village,
Unit II, on September 6, 1989; and,
WHEREAS, this right -of -way would not be adequate to serve
the new lift station designed for this project; and,
WHEREAS, the appraisal, has been adjusted to meet the right -
of -way requirements and appraisals have also been completed and
are on file in the Property Management Office for two temporary
work easements that are necessary for this construction.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purpose of constructing a
new Lift Station #8.
SECTION 2. The legal descriptions of the easements to be
acquired are as follows:
Parcel #LS8 -1
A 2,722 square foot tract out of Lot 7, Block 70,
Faith Village, Unit II.
Parcel #LS8 -1 TCE
A 2,361 square foot temporary construction
easement out of Lot 7, Block 70, Faith Village,
Unit II.
Parcel #LS8 -2 TCE
A 4,222 square foot temporary construction
easement out of Lot 6, Block 70, Faith Village,
Unit II.
The above listed easements being fully described by metes and
bounds in field surveys prepared by Corlett, Probst & Boyd, Inc.
SECTION 3. The amount of just compensation for the
easements to be acquired are as follows:
#LS8 -1 $6,125.00 #LS8 -2 TCE $1,900.00
#LS8 -1 TCE $ 708.00
These amounts are also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise the tracts.
SECTION 4. In the event the Property Administrator is
unable to purchase the parcels for the appraised value, the City
Manager is authorized to increase the offer when, in his
judgment, it appears to be in the best interest of the City to do
so to save the cost of condemnation. If both parties are unable
to agree upon a value for the property, the City Attorney is
hereby authorized to institute condemnation proceedings to obtain
such property in the name of the City of Wichita Falls for Sewer
Lift Station #8.
