RESOLUTION TO APPROVE PROPOSED AMENDMENT TO
WATER PURCHASE CONTRACT WITH WICHITA VALLEY
WATER SUPPLY CORPORATION
WHEREAS, the City of Wichita Falls and Wichita Valley Water
Supply Corporation have a Water Purchase Contract that authorizes
the purchase of raw water from Lake Kickapoo by the Corporation;
WHEREAS, Corporation recently has requested authority to
purchase treated water from the City to supplement the
Corporation treatment and distribution system, said treated water
to be provided from a tap to be installed on FM Highway 369;
WHEREAS, the City may, in the future, annex an area
generally between Turtle Creek Road and FM Hwy. 369 and between
the Seymour Hwy. and Wichita River, said area being located
within the State - approved certificated area where Wichita Valley
Water Supply Corporation has exclusive right to serve water;
WHEREAS, should the annexation action be taken, City desires
to have the exclusive right of water service within the annexed
area, and to purchase the Corporation rights and distribution
system;
WHEREAS, the City staff and Corporation staff have
negotiated a methodology to define the cost and procedures for
Corporation relinquishing its right and distribution assets in
the potential annexation area and for City to assume the water
service responsibilities; and,
WHEREAS, the Council has reviewed a proposed second
amendment to the Water Purchase Contract with Wichita Valley
Water Supply Corporation to effect the treated water tap and the
purchase methodology.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
That certain stated Second Amendment to the Water Purchase
Contract between the City of Wichita Falls and Wichita Valley
Water Supply Water Corporation is hereby approved, and the City
Manager is authorized to execute the amendment for the City.
