RESOLUTION OF THE CITY COUNCIL AUTHORIZING
THE MAYOR TO EXECUTE A QUIT CLAIM DEED TO
KATHY V. MCKINLEY, CONVEYING A PORTION OF A
UTILITY EASEMENT; FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS RESOLUTION WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW.
WHEREAS, the City has received a request from Kathy V.
McKinley to convey by quit claim deed a seven and one-half foot
portion of a dedicated utility easement at the rear of #1 Deanna
Circle, Lot 30 of a replat of part of Block 7, McKenzie
Subdivision of the City of Wichita Falls, Texas; and,
WHEREAS, said portion of such dedicated utility easement
does not contain any existing utilities and is unnecessary for
future utility purposes; and,
WHEREAS, the City has caused the same to be appraised and
finds the fair market value to be Four Hundred Thirty ( $430.00)
Dollars.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. In consideration of the receipt of the sum of
Four Hundred Thirty ( $430.00) Dollars, the Mayor be and is hereby
authorized to execute a quit claim deed to Kathy V. McKinley,
conveying a portion of a utility easement at the rear of Lot 30
of a replat of part of Block 7, McKenzie Subdivision in the City
of Wichita Falls, and as further described by the attached quit
claim deed, the same made a part hereof for all purposes.
SECTION 2. It is hereby officially found and determined
that the meeting at which this resolution is passed is open to
the public as required by law and that public notice of the time,
place, and purpose of said meeting was given as required.

QUIT CLAIM DEED
STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA ) (
THAT the City of Wichita Falls, Texas, a municipal
corporation, hereinafter called Grantor, acting by and through
its duly authorized Mayor, for and in consideration of the sum of
Four Hundred Thirty ( $430. 00 ) Dollars and other good and valuable
consideration, in hand paid by Kathy V. McKinley, hereinafter
called Grantee, the receipt of which is herein acknowledged, has
granted, sold, conveyed, released, and forever quit claims unto
the said Grantee, all its right, title, and interest in and to
the following described real property situated in Wichita County,
Texas, to-wit:
A 7 . 5 foot wide portion of a 15 foot wide utility
easement in Lot 30 , of a replat of Block 7 , McKenzie
Subdivision, being more specifically described as
follows:
BEGINNING at a point lying on the South right-of-way of
Scottsdale Drive, said point being 7 . 5 feet West of the
Northeast corner of said Lot 30 of a replat of Block 7 ,
McKenzie Subdivision, and also being the Northeast
corner and the Place of Beginning of this description;
THENCE in a Southerly direction, parallel to, and at a
distance of 7. 5 feet from the East lot line of said
lot, approximately 90 feet to the South lot line of
said lot;
THENCE in a Westerly direction approximately 7 . 5 feet
along the South lot line of said lot to the western
edge of the existing 15 foot wide utility easement;
THENCE in a Northerly direction, along the Western edge
of the existing 15 foot wide utility easement,
approximately 90 feet to a point on the South right-of-
way line of Scottsdale Lane;
THENCE in an Easterly direction, along the South right-
of-way line of Scottsdale Lane, approximately 7 . 5 feet
to the Place of Beginning.

SAVE AND EXCEPT that any easements are reserved for any and
all existing utilities as may be now located in said above
described property, with the right of ingress and egress to same
for the purpose of operation, maintenance, or removal of such
utilities until such shall be abandoned or relocated.
TO HAVE AND TO HOLD the above described premises, together
with all and singular the appurtenances thereto, except as
otherwise reserved, in any way belonging unto the said Grantee,
its successors and assigns, as above provided.
Grantor acknowledges and confesses that it has caused the
above described premises to be appraised as required by Article
5421c-12, V.A.C.S. , and that the consideration herein expressed
represents the fair market value as required by Article 5421c-12 ,
V.A.C.S.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a
municipal corporation of Wichita County, Texas, has caused this
instrument to be executed by its Mayor this the day of
September, 1991 .
