RESOLUTION DETERMINING NECESSITY FOR
ACQUISITION OF PROPERTY FOR THE EXTENSION OF
RED FOX ROAD, APPROVING THE APPRAISALS,
SETTING JUST COMPENSATION, AND AUTHORIZING
PURCHASE OR CONDEMNATION.
WHEREAS, the City Council approved the extension of Red Fox
Road southward to Maurine Street in the 1990-91 CDBG Budget; and,
WHEREAS, on May 7, 1991, a contract was approved for
Corlett, Probst & Boyd, Inc. , to provide the necessary
engineering services on this project; and,
WHEREAS, the plans have now been completed and appraisals
have been prepared on the right-of-way necessary for this
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. It is necessary that the City of Wichita Falls
acquire the hereinafter described property located in Wichita
Falls, Wichita County, Texas, for the purposes of providing the
necessary right-of-way for the Red Fox Road Extension Project.
SECTION 2. The legal descriptions of the parcels to be
acquired in fee simple title in the name of the City of Wichita
Falls are as follows:
Parcel #RF-1
A 0. 005 acre tract out of Lot 1, Block 19, Lynwood Addition.
Parcel #RF-2
A 0. 949 acre tract out of the E. Scurry Survey, Abstract
481.
Parcel #RF-3
Tract I ) A 0. 520 acre tract out of the E. Scurry Survey,
Abstract 481.
Tract II ) A 0. 134 acre tract out of the E. Scurry Survey,
Abstract 481.
The legal description of the drainage easement to be
acquired is as follows:
Parcel #RF-2 (E)
A 0. 388 acre tract out of the E. Scurry Survey, Abstract
481.
The legal description of the 18 month temporary construction
easement to be acquired is as follows:
Parcel #RF-2 (TCE)
A 0. 488 acre tract out of the E. Scurry Survey, Abstract
481.
The above-described tracts being fully described by metes
and bounds in field surveys prepared by Corlett, Probst & Boyd,
Inc.
SECTION 3 . The amount of just compensation for the parcels
to be acquired is as follows:
RF-1 94 . 00 RF-2(E) 1,086.00
RF-2 3 ,322. 00 RF-2(TCE) 171. 00
RF-3 2,943 .00
These amounts are also the fair market value determined by
Henderson Appraisal and Consultants, who were employed by the
City to appraise these tracts. The Property Administrator is
hereby authorized to acquire fee simple title in the name of the
City of Wichita Falls on Parcels #RF-1, RF-2, and RF-3 , a
drainage easement on Parcel #RF-2(E) , and a temporary
construction easement on Parcel #RF-2(TCE) .
SECTION 4. In the event the Property Administrator is
unable to purchase the parcels for the appraised value, the City
Manager is authorized to increase the offer when, in his
judgment, it appears to be in the best interest of the City to do
so to save the cost of condemnation. If both parties are unable
to agree upon a value for the property, the City Attorney is
hereby authorized to institute condemnation proceedings to obtain
such property in the name of the City of Wichita Falls for the
extension of Red Fox Road.
