RESOLUTION DECLARING A STRIP OF RIGHT-OF-WAY
ON EAST SCOTT AS SURPLUS PROPERTY.
WHEREAS, on November 22, 1933 , the City of Wichita Falls
acquired a 0.517 acre tract of land in the J. A. Kemp Addition to
be used as right-of-way for State Highway No. 5; and,
WHEREAS, a 0. 103 acre portion of this 0 . 517 acre tract is
not being used for right-of-way purposes and the City of Wichita
Falls does not foresee a need for said property in the future.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The City Council of Wichita Falls, Texas, does hereby
declare that a certain 10 foot x 450 foot strip of land,
described in Exhibit A attached hereto, is part of BU 287 J (Loop
370) in the City of Wichita Falls and is under the jurisdiction
of the State Department of Highways and Public Transportation and
is on the State Highway System. Said 10 foot x 450 foot ( 0. 103
acre) strip of land is owned by the City of Wichita Falls and is
a portion of right-of-way abutting a public road (East Scott
Street) .
By this resolution, the City Council is requesting that the
State Department of Highways and Public Transportation declare
said property described in Exhibit A to be surplus to their needs
and to transfer jurisdiction and maintenance responsibility of
said land to the City of Wichita Falls in the form of a quitclaim
deed.

Being 0 . 103 of one acre of land, more or less, out of and a part
of a 0 . 517 acre tract in the J. A. Kemp Addition; said 0 . 517 acre
tract being the same land described in a deed from Frank Kell to
the City of Wichita Falls dated November 22, 1933 , recorded in
Volume 325, Page 446 , Deed Records of Wichita County, Texas; said
0 . 103 of one acre of land, more or less , being more particularly
described by metes and bounds as follows :
COMMENCING at the northwest corner of Lot 1 , Block 19 , of the
J. A. Kemp Addition;
THENCE, South 00° 16 ' East along the west line of Lot 1, a
distance of 100 . 00 feet to a point , said point being the northwest
corner of the tract of land conveyed from Frank Kell to the City
of Wichita Falls , Volume 325 , Page 446, Deed Records of Wichita
County, Texas; said point further being situated in the existing
north right of way line Survey Line Station 106+09 . 84 of BU 287J
Loop 370 ) , and 60 feet left of Engineer ' s Survey Line Station
160+08 . 51 of existing BU 287J, said point also being the POINT OF
BEGINNING:
THENCE North 89° 44 ' East along the south line of Lots 1 through 9
inclusive) , Block 19 , of the J. A. Kemp Addition and the existing
north right of way line of BU 287J (Loop 370 ) , a distance of
450 . 00 feet to a point , said point being the southeast corner of
