A RESOLUTION AUTHORIZING AN ALLEY ENCROACHMENT BY AN EXISTING
BUILDING LOCATED AT 900 BROOK AVENUE, WICHITA FALLS, TEXAS
WHEREAS, the existing building located at 900 Brook Avenue
encroaches over the alley right-of-way by 0.3 feet; and,
WHEREAS, the encroachment does not obstruct pedestrian or
vehicular traffic; and,
WHEREAS, the public and private utility companies have no
objections to this existing encroachment; and,
WHEREAS, the City Council deems that the encroachment will not
adversely impact the health, safety, and public welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The 124. 1 ft. x 0.3 ft. alley encroachment by the
existing building located at 900 Brook Avenue, Wichita Falls,
Texas, as shown on the attached diagram (Attachment No. 1) is
hereby authorized.
SECTION 2 . The building owner, his heirs and assigns shall
hold the City harmless from any and all claims, actions or
liabilities associated with owner's use or maintenance of the
encroachment.
