Res 045-91 3/19/1991RESOLUTION NO. l7 RESOLUTION DETERMINING NECESSITY FOR ACQUISITION OF UTILITY EASEMENTS FOR THE NORTH DRAINAGE BASIN SANITARY SEWER IMPROVEMENT PROJECT, APPROVING THE APPRAISALS, SETTING JUST COMPENSATION, AND AUTHORIZING PURCHASE OR CONDEMNATION. WHEREAS, it has been determined that the City of Wichita Falls must acquire certain utility easements and temporary construction easements for the installation of a sewer trunk main as part of the North Drainage Basin Sanitary Sewer Improvement Project; and, WHEREAS, appraisals have been made on these tracts and reviewed by the Property Administrator and are now on file in the Property Management Office. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. It is necessary that the City of Wichita Falls acquire the hereinafter described property located in Wichita Falls, Wichita County, Texas, for the North Drainage Basin Sanitary Sewer Improvement Project. SECTION 2. The legal descriptions of the permanent utility easements to be acquired are as follows: Parcel #1 A 0. 16 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #1-A A 0. 12 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #1-B A 0 .12 acre tract out of the S.L.B. Jasper Survey, A-168 . Parcel #1-C A 0. 53 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #2 A 0. 69 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #3 A 0.77 acre tract out of the S.L.B. Jasper Survey, A-168. The legal descriptions of the twenty-four ( 24) month temporary construction easements to be acquired are as follows: Parcel #TCE-1 A 0. 04 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-2 A 0 . 04 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-3 A 0 . 23 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-4 A 0. 22 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-5 A 0. 06 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-6 A 0.05 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-7 A 0. 24 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-8 A 0. 27 acre tract out of the S.L.B. Jasper Survey, A-168. Parcel #TCE-9 A 0. 18 acre tract out of the S.L.B. Jasper Survey, A-168. The above-listed permanent and temporary easements are fully described by metes and bounds in field surveys prepared by Biggs Mathews, Inc. , in February, 1991. SECTION 3 . The amount of just compensation for the permanent utility easements to be acquired is as follows: Parcel #1 154. 00 1-C $509. 00 1-A 115. 00 2 662. 00 1-B 115. 00 3 739.00 The amount of just compensation for the temporary construction easements to be acquired is as follows: Parcel #TCE-1 $ 5. 00 TCE-6 $ 6.00 TCE-2 5. 00 TCE-7 29. 00 TCE-3 28 .00 TCE-8 32. 00 TCE-4 26. 00 TCE-9 22. 00 TCE-5 7. 00 These amounts of just compensation are also the fair market value determined by Henderson Appraisal and Consultants, who were employed by the City to appraise the tracts. SECTION 4. In the event the Property Administrator is unable to purchase the parcels for the appraised value, the City Manager is authorized to increase the offer when, in his judgment, it appears to be in the best interest of the City to do so to save the cost of condemnation. If both parties are unable to agree upon a value for the property, the City Attorney is hereby authorized to institute condemnation proceedings to obtain such property in the name of the City of Wichita Falls for permanent utility easements and temporary construction easements for the North Drainage Basin Sanitary Sewer Improvement Project.
