AN ORDINANCE CLOSING, VACATING, AND ABANDONING, A TWELVE (12)
FOOT WIDE ALLEY IN BLOCK 1, FELLOWS ADDITION, WICHITA FALLS,
TEXAS, AND RETAINING AN UTILITY EASEMENT.
WHEREAS, the Planning & Zoning Commission of the City of Wichita
Falls has recommended the closure of a twelve (12) foot wide alley in Block 1,
Fellows Addition, Wichita Falls, Texas, subject to the retention of an utility
easement; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas
deems it advisable and in the public interest to close, vacate, and abandon
the alley hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The twelve (12) foot wide north-south alley lying in
Block 1, Fellows Addition, Wichita Falls, Texas, having for its north boundary,
the south right-of-way line of 23rd street, and bounded on the south by the north
right-of-way line of a twenty (20) foot wide east-west alley is hereby closed,
vacated, and abandoned.
SECTION 2. The City of Wichita Falls hereby reserves the entire area
described in Section 1 as an utility easement for the purpose of laying and
maintaining all kind and character of utility lines including water, gas, electric,
telephone, television cable, power lines, and sanitary and storm sewer.
SECTION 3. The utility easement described in Section 2 shall be kept
open for vehicular access as required by the Public Utilites Department.
