ORDINANCE WAIVING SECTION 31-41 OF THE
CODE OF ORDINANCES , WHICH REQUIRES
COUNTY RESIDENCE FOR CAB DRIVERS , FOR
JIM R. SANDERS .
WHEREAS, Jim R. Sanders has lived in Byers, Texas, for three
years; prior to that, he resided in Wichita Falls for five years,
but he has continued to work in Wichita Falls while living in
Byers; and,
WHEREAS , for the past year, Mr . Sanders has been a bus driver
for the Wichita Falls Independent School District; during the
summer months , he is unemployed from the school system, and he has
an opportunity to drive a cab in Wichita Falls; and,
WHEREAS, Section 31-41 of the Code of Ordinances provides that
no person shall be issued a chauffeur 's license to drive a taxicab
unless he shall have resided in Wichita County at least six months
consecutively next preceding the filing of an application for such
license, and Mr . Sanders has asked for a waiver of this requirement;
and,
WHEREAS, the City Council finds that the circumstances involved
in this situation are exceptional , in that Mr . Sanders lived in
Wichita Falls for five years, has worked in Wichita Falls for approx-
imately eight years, and regularly drives a bus in Wichita Falls
for the Wichita Falls Independent School District .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT:
The provisions of Section 31-41 of the Code of Ordinances,
requiring that the holder of a chauffeur 's license to drive a
taxicab must have resided in Wichita County at least six months
consecutively next preceding the filing of an application, is hereby
waived with regard to Jim R. Sanders .
As Mr . Sanders is in urgent need for employment during the
summer, so that he can make a living for his family, this measure
is declared to be an emergency on the ground of urgent public need
for the preservation of the peace, health and safety of property of
the City, and it shall become effective immediately upon its passage .
