ORDINANCE NO. 77-85
ORDINANCE AMENDING SECTIONS 8-15, 8-171,
8-172 AND 8-174 OF THE CODE OF ORDINANCES
TO ALLOW FOOD VENDING WITHIN CERTAIN DESIG-
NATED AREAS OF THE CITY OF WICHITA FALLS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 8-15, subsection (c) of the Code of
Ordinances is hereby amended to read as follows:
" (c) Nothing in this section or Sections 8-2, 8-16 or
27-5 shall prohibit food vendors from carrying on their business
in those certain designated areas of the city set forth in
Chapter 8, Article VIII of the Code, provided all regulations
in such Article VIII have been complied with. "
SECTION 2. Section 8-171 of the Code of Ordinances is
hereby amended to read as follows:
"Section 8-171 -- Compliance with Article.
It shall be unlawful for a person to operate a mobile
food vending unit or vend food items afoot in the designated
areas of the city without complying with the provisions of
this article. "
SECTION 3. Section 8-172, Subsection (a) of the Code
of Ordinances is hereby amended to read as follows :
" (a) Designated areas means the public sideawalks within
the districts of the City designated as limited commercial,
general commercial, heavy commercial, heavy industrial, central
business and river development in the zoning ordinance. "

SECTION 4 . Section 8-172, Subsection (b) of the Code
of Ordinances is hereby repealed.
SECTION 5. Section 8-174 of the Code of Ordinances is
hereby amended by adding a new Subsection (m) , which shall
read as follows:
" (m) Solicit or conduct business within 100 feet of the
place of business of any merchant who sells food for immediate
consumption, or solicit or conduct business on the public
sidewalk abutting the property of a merchant or property owner
who objects. "
