AN ORDINANCE AMENDING AND DELETING CERTAIN SECTIONS OF CHAPTER
4, ALCOHOLIC BEVERAGES, OF THE WICHITA FALLS CODE OF ORDINANCES
WHEREAS, the locational criteria for alcoholic beverage sales is being
incorporated into the Zoning Ordinance; and,
WHEREAS, certain sections of the existing code need to be aligned with
the Texas Alcoholic Beverage Code, as amended; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to amend and delete certain sections of
the existing code hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
SECTION 1. Section 4-3 of the Wichita Falls Code of Ordinances is hereby
amended to read as follows:
"Section 4-3. Delivery Prohibited. No alcoholic beverage shall be delivered
to the ultimate consumer by any person holding any class or character of license
or permit under the Texas Alcoholic Beverage Code, as amended, whether such person
is on foot or uses any known method of conveyance within the corporate limits
of the city."
SECTION 2. Section 4-10 of the Wichita Falls Code of Ordinances is hereby
amended to read as follows:
"Section 4-10. Hours for sale of beer and other malt beverages. It shall
be unlawful for anyone to sell or offer for sale within the city, any beer or
other malt beverage between the hours of 12:00 a.m. and 7:00 a.m. of each and
every day except Sunday. On Sunday, it shall be unlawful for anyone to sell or
offer for sale within the city, any beer or other malt beverage between the hours
of 1:00 a.m. and noon. "
SECTION 3. Section 4-11 of the Wichita Falls Code of Ordinances, Defi-
nitions, is hereby amended to delete the definitions of "Restaurant" and
"Shopping Center".
SECTION 4. Section 4-15 of the Wichita Falls Code of Ordinances is hereby
amended to read as follows:
"Section 4-15. Sales, etc. in unauthorized areas. No distilled, vinous
or malt liquors or beer shall be sold within the corporate limits of the City
of Wichita Falls, Texas, and no license or permit shall be issued for the sale
of same, except in the areas in which sales are authorized by the Zoning Ordinance,
as amended."

SECTION 5. Sections 4-16, 4-17, 4-18, 4-18.1, 4-19, 4-19.1, 4-22, 4-23,
4-24, & 4-26 of the Wichita Falls Code of Ordinances are hereby deleted.
