RESOLUTION TO APPROVE ENCROACHMENT AGREEMENT
FOR ENCROACHMENTS INTO ALLEY ADJACENT TO 509
VIRGINIA STREET
WHEREAS, the City has a public right-of-way alley adjacent
to private property located at 509 Virginia Street, and an 18"
sanitary sewer line is installed in the alley;
WHEREAS, the owner of 509 Virginia Street has encroached
into the alley with several structures, thereby preventing proper
maintenance and repair of the sanitary sewer line;
WHEREAS, the owner has removed several of the structures
from public the right-of-way of his own volition, but has
requested authority for a house at the rear of the main residence
and a carport on the main residence to encroach into the alley;
WHEREAS, the owner has agreed to execute an encroachment
agreement with the City such that the City is held harmless from
any damage to the encroachments that may be caused by the use of
the right-of-way for public purposes; and,
WHEREAS, the City Council has examined the encroachment
agreement and desires to authorize the encroachments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The stated encroachment agreement is hereby approved and the
City Manager is authorized to execute the same or the City.
