RESOLUTION TO ACCEPT NORTHSIDE SANITARY SEWER
TRUNK MAIN, PHASE I PROJECT AS COMPLETE AND
AUTHORIZE FINAL PAYMENT TO CONTRACTOR
WHEREAS, the City of Wichita Falls has a contract with
Benson Construction Company, of Haughton, Louisiana for the
construction of a major sanitary sewer trunk main in the North
Drainage Basin of the City;
WHEREAS, the original contract amount of $1, 065, 101 was
increased by approved change orders during the project to a final
contract price of $1, 068, 604 .50;
WHEREAS, the actual amount of work accomplished by the
contractor was $1, 028, 227.80, and the City has made payments in
the amount of $1, 005, 105.44, leaving an amount due to the
contractor of $23, 122 . 36;
WHEREAS, during the course of the project, the contractor
caused damages to a City water line in the amount of $301.33,
which damages are to be withheld from the contractor's final
payment, leaving an amount due to the contractor of $22,821. 03 ;
and,
WHEREAS, the work has been inspected and found to be in
compliance with the plans and specifications, and the staff has
recommended Council accept the project as complete.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The Northside Sanitary Sewer Trunk Main, Phase I Project is
hereby accepted as complete and the City Manager is authorized
to make a final payment of $22,821. 03 to the"- • tractor.
