A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS DETERMINING NECESSITY FOR
ACQUISITION OF PROPERTY FOR THE MULTI-PURPOSE
EVENT CENTER AND AUTHORIZING PURCHASE OR
CONDEMNATION; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS RESOLUTION WAS
PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY
LAW.
WHEREAS, certain parcels of real property have been
designated for acquisition for the City/County Multi-Purpose
Event Center; and,
WHEREAS, independent appraisers will be hired to appraise
each tract, and the fair market value determined by the appraisal
will be the amount offered to the property owner.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. That a public necessity exists that the City of
Wichita Falls acquire the property, known as the North Tract and
the South Tract, shown on the attached maps and located in
Wichita Falls, Wichita County, Texas, for the development of the
City/County Multi-Purpose Event Center.
SECTION 2. The amount of just compensation to be offered to
the property owners will be the fair market value as determined
by independent appraisers who will be employed by the City to
appraise each tract.
SECTION 3 . In the event the Property Administrator is
unable to purchase the parcels for the appraised value, the City
Manager is authorized to increase the offer when, in his
judgment, it appears to be in the best interest of the City and
County to do so to save the cost of condemnation. If the
Property Administrator is unable to reach an agreement on the
value of the property, the City Attorney is hereby authorized to
institute condemnation proceedings to obtain said property for
the City/County Multi-Purpose Event Center.
SECTION 4. It is hereby officially found and determined
that the meeting at which this resolution was passed was open to
the public as required by law.
