RESOLUTION TO ACCEPT LAKE KICKAPOO DAM
IMPROVEMENTS PROJECT AS COMPLETE AND CONFIRM
FINAL PAYMENT TO CONTRACTOR
WHEREAS, the City of Wichita Falls has a contract with J.
E. Haynes Construction Company of Decatur, Texas for certain
specified improvements on the Lake Kickapoo Dam;
WHEREAS, the original contract amount of $797, 203 has been
changed by approved Change Orders, additional quantities,
liquidated damages and a negotiated settlement for claims to an
amount of $817,280. 05;
WHEREAS, the negotiated settlement has been agreed by the
Contractor through his attorney;
WHEREAS, the City has made previous payments in the amount
of $758, 203 . 36, leaving an amount due of $59, 076.69 to meet the
new contract price of $817,280. 05;
WHEREAS, this final payment has been made to the Contractor
through the Contractor's attorney, and the Council desires to
confirm the final payment; and,
WHEREAS, on recommendation of the staff, Council desires to
accept the Lake Kickapoo Dam Improvements Project as complete.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The Lake Kickapoo Dam Improvements Project is accepted as
complete in accordance with the contract specifications and the
settlement agreement between the City and the Contractor. The
final payment of $59, 076. 69 to the Contractor through the
Contractor's attorney is hereby confirmed.
