A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS DECLARING PROPERTY AT 912
CEDAR STREET AS EXCESS AND APPROVING SALE TO
ADJACENT OWNERS.
WHEREAS, the property at 912 Cedar Street was acquired by
the City of Wichita Falls, Wichita County, and the Wichita Falls
Independent School District as the result of a delinquent tax
suit; and,
WHEREAS, said property has served as a driveway for many
years to the residences at 910 and 1000 Cedar Avenue; and,
WHEREAS, in accordance with the law, the City of Wichita
Falls desires to sell this property for the appraised fair market
value to the adjacent properties at the above-listed addresses.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. As authorized by Chapter 272 of the Local
Government Code, the City of Wichita Falls shall sell its
interest in the following described excess property located in
Wichita Falls, Wichita County, Texas:
A 60 ' x 225 ' tract out of the E. A. Austin Survey,
Abstract 701, a/k/a 912 Cedar, Wichita Falls, Texas,
and further described as follows:
BEGINNING at a point in the West line of the E. A.
Austin Survey, 1,562 feet West of the Southwest corner
of Block 2 of the West Side Addition to the Floral
Heights Addition to the City of Wichita Falls;
THENCE South 60 feet;
THENCE East 225 feet;
THENCE North 60 feet;
THENCE West 225 feet to the Place of Beginning.
The North one-half of the above-described tract is to be
conveyed by Special Warranty Deed to Mr. Cortez Nall for the fair
market value of $1,350.00. The South one-half of the above-
described tract is to be conveyed to Mr. Troy Stewart by Special
Warranty Deed for the fair market value of $1,350. 00.
The Mayor is hereby authorized to execute the deed on behalf
of the City of Wichita Falls.
SECTION 2. It is hereby officially found and determined
that the meeting at which this resolution was passed is open to
the public as required by law.
