ORDINANCE NO. 9-86
ORDINANCE ESTABLISHING CHAPTER 20 , SECTION 25 OF
THE CODE OF ORDINANCES TO PROHIBIT AN INDIVIDUAL
FROM LOITERING IN OR ADJACENT TO A PUBLIC PLACE
FOR THE PURPOSE OF INDUCING, ENTICING, SOLICITING,
OR PROCURING ANOTHER TO COMMIT AN ACT OF PROSTITUTION.
WHEREAS , the Wichita Falls City Council finds that the health,
safety, and welfare of the community will be properly served by
prohibiting such conduct.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT:
Chapter 20 , Section 25 of the Wichita Falls Code of Ordinances
shall read as follows :
"Sec . 20-25 . Manifesting the Purpose of Engaging in
Prostitution.
A. It shall be unlawful for any person to loiter or remain
in a public place or adjacent to a public place, in a manner and
under circumstances manifesting the purpose of inducing, enticing,
soliciting, or procuring another to commit an act of prostitution.
(1) Among the circumstances which may be considered in
determining whether such purpose is manifested : that such person
is a known prostitute or panderer, and/or repeatedly beckons to,
stops or attempts to stop, or engages passers-by in conversation,
or repeatedly stops or attempts to stop motor vehicle operators
by hailing, waving of arms , or any other bodily gesture .
(2) No arrest shall be made for a violation of this
subsection unless the arresting officer first affords such person
an opportunity to explain such conduct, and no one shall be
convicted of violating this section if it appears at trial that
the explanation given was true and disclosed a lawful purpose .
(3) For the purpose of this section, a "known
prostitute or panderer" is a person who, within one (1) year previous
to the date of arrest for violation of this section, has , within
the knowledge of the arresting officer, been convicted of prostitu-
tion, promotion of prostitution, aggravated promotion of prostitution,
or compelling prostitution.
B. Any person convicted of violating this section shall be
punished by a fine not exceeding Two Hundred Dollars ($200 .00) ."
