ORDINANCE NO.
ORDINANCE AMENDING ARTICLE IV, SECTION 5-23 OF
ORDINANCE 63-85 TO PROVIDE FOR THE IMPOUNDMENT
AND DISPOSAL OF VICIOUS ANIMALS .
WHEREAS, the Wichita Falls City Council finds that the health,
safety and welfare of the community will be properly served by the
impoundment and destruction of vicious animals .
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS , TEXAS, THAT :
Article IV, Section 5-23 (a) (2) is hereby amended to read as
follows :
" (2) Vicious Animals
(a) . Every animal (including dogs and cats) of fierce,
dangerous or vicious propensities, shall be securely confined
within a building or enclosure sufficient to prevent their running
at-large . Such an animal shall not be removed from said building
or enclosure, unless securely leashed or humanely caged .
Such animal shall not be allowed upon any street,
avenue, highway, alley, sidewalk, parkway, park or other public
place in the City, whether or not said animal is under control by
means of a leash, chain or otherwise provided, nor shall such
animal be transported in an open bed vehicle, whether or not said
animal is under control by means of a leash, chain or otherwise .
Any animal that has, without provocation, attacked or bitten a
human being, or attacked another animal, fowl or livestock, shall
be considered vicious .
(b) . If the Animal Control Department receives a complaint
that an animal is vicious and the complainant will give a sworn
statement with particulars concerning the complaint, a thorough
investigation shall be made . In the event of controversy regarding
the vicious status of an animal, the final decision shall be that
of the local health authority .
(c) . If it is determined that an animal is vicious and its
destruction or removal is necessary to preserve the public health,
safety and welfare of the community, the harborer shall be given
official notice to destroy or remove the animal within twenty-four
(24) hours , or the animal will be impounded. The owner of such
animal shall have five (5) calendar days in which to make a written
appeal to the Director of the WichitaFalls-Wichita County Public
Health District .
Should the release of the animal in question be
allowed, impoundment and other fees shall be paid prior to release .
(d) . Any animal determined to be vicious by the Director of
the Wichita Falls-Wichita County Public Health District may be
destroyed if :
(1) . written appeal to the Director is not made by
the animal owner within five (5) calendar days from receipt of
the official notice to destroy or remove such animal; or,
(2) . after written appeal by the owner of such
animal, it is determined by the Director that the animal is or
remains a danger to the public health, safety and welfare of the
community and should be destroyed; or,
(3) . the animal is returned to and found within the
limits of the City after its removal has been ordered by Health
Department officials; or,
(4) . the owner of such animal fails to or refuses to
remove or destroy the animal as requested by official notice or
order of the Director of Health .
(e) . Seizure Warrant.
If the harborer of a vicious animal refuses to release
such animal to the Animal Control Warden, then it shall be the
duty of the Animal Control Supervisor or his designee to obtain a
seizure warrant from the magistrate or acting magistrate, for
seizure of the animal in question. " 2 �
