Ord 028-86 4/1/1986 ORDINANCE NO. 28-86
AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE
ZONING ORDINANCE OF THE CITY OF WICHITA FALLS, TEXAS.
WHEREAS, the Planning and Zoning Commission has recommended
that certain sections of the Zoning Ordinance be amended; and,
WHEREAS, the proposed amendments are in accordance with the
City's Comprehensive plan; and,
WHEREAS, the City Council of the City of Wichita Falls, Texas,
deems it advisable and in the public interest to amend the zoning
text hereafter described.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1.
Sections 3080(8) , 3140( 8) , 3210(6) , 3290(6) ,and 3410(6) of the
Zoning Ordinance of the City"'of'Fiidhita Falls, Texas, are
hereby amended to read as follows:
"Rear Setback:
A. Single-family and duplex residential uses:
Primary structures: 10 ft, minimum.
Accessory buildings of 150 sq. ft. or more: 5 ft. , minimum
from common lot lines or 1 ft. , minimum when abutting
an alley.
Accessory buildings less than 150 sq. ft. : 1 ft. , minimum.
B. All other uses: 5 ft. , minimum.
However, in no case shall the roof overhang extend over the
property line. "
SECTION 2.
Section 3490(4) of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"Side Setback, Interior:
A. Single-family and duplex residential uses:
5 ft. , minimum.
B. All other uses: No minimum.
Rear Setback:
A. Single-family and duplex residential uses:
Primary structures: 10 ft. , minimum.
Accessory buildings of 150 sq. ft. or more: 5 ft. , minimum
from common lot lines or 1 ft. , minimum when abutting
an alley.
Accessory buildings less than 150 sq. ft. : 1 ft. , minimum.
B. All other uses: No minimum.
However, in no case shall the roof overhang extend over the
property line. "
SECTION 3 .
Section 5250 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"The minimum rear setback for primary structures shall be 10
ft. ; for accessory buildings it shall be 5 ft. from common
lot lines, or 1 ft. when lot abuts an alley. However, in
no case shall the roof overhang extend over the property
line. When vehicle access is taken from the alley, that
portion of the structure that contains the garage or
carport, shall be set back at least twenty ( 20) feet from
the edge of the alley pavement closest to the property
line. "
SECTION 4.
Sections 3210(8) , 3290( 8) , 3410( 8) , 3490(7) of the Zoning
Ordinance of the City of Wichita Falls, Texas, is hereby amended
to add the following clause at the end of the sentence:
" , except 40% of lot area, maximum, for single-
family and duplex residential uses. "
SECTION 5.
Section 4230 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"The minimum rear setback of a through lot shall be the same as
the exterior side setback on the lot. No accessory buildings
shall be allowed within the rear setback area of a through lot.
SECTION 6.
Section 6210(G) of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"Vehicular alley access for ingress an egress to off-street
parking facilities for other than single family or duplex
residential uses shall be permitted, except when screening
is required along the alley under the provisions of Section
4620. "
SECTION 7.
Section 2030 "FRONTAGE, LOT" of the Zoning Ordinance of the City
of Wichita Falls, Texas, is hereby amended to read as follows:
"See Lot frontage. "
SECTION 8.
Section 6820 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to add the following to the end
of the paragraph:
"A final certificate of occupancy may be issued without the
required landscaping in place provided, that assurances are
given in writing as to the date when landscaping will be
installed. All landscaping shall be installed no later
than 6 (six) months after the issuance of a certificate of
occupancy."
SECTION 9.
Section 6830 of the Zoning Ordinance of the City of Wichita
Falls, Texas is hereby amended to add the following:
"I. In certain cases where large tracts of land are to be
developed in phases, or where street frontages are unusually
large or small relative to the size of the development, the
Director of Planning may authorize an adjustment of the number
of trees required by Section 6830(B) . Such requirements shall
be proportional to the area-developed and consistent with
requirements of other developments of a similiar size. "
SECTION 10.
Section 6261 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to add the following to the end
of subsection OPTION 1. :
"Curb return radii for single-family & duplex residential uses
shall be allowed to extend in front of the adjacent property."
SECTION 11.
Section 7650(D) of the Zoning Ordinance of the City of Wichita
Falls, is hereby amended to read as follows:
"Zoning Amendments (Rezoning) : $25.00
Rezoning signs: $ 5.00 per sign."

SECTION 12.
Sections 7650(C) & (E) of the Zoning Ordinance of the City of
Wichita Falls, Texas, are hereby amended to add the following:
"Signs: $5.00 per sign."
SECTION 13 .
Sections 3280, 3470 and 3530 of the Zoning Ordinance of the
City of Wichita Falls, Texas, are hereby amended to add the
following in the Commercial Uses subsection:
"Services"
SECTION 14.
Section 5420 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"There shall be five (5) types of permitted alcoholic
beverage sales in areas where such sales are permitted
by law:
1. ON-PREMISE PRIMARY USE SALES: Sales of alcoholic
beverages as a primary use for consumption on the premise
where sold.
Such sales are authorized in the HC, RDD, and CBD
zones. Such sales are also authorized in the GC zone
subject to the Conditional Use approval process in Section
7200.
USE ON-PREMISE INCIDENTAL U E SALES: Sales of alcoholic
beverages as an incidential use for consumption on the
premise where sold.
Such sales are authorized in the GC, HC, HI, RDD, and
CBD zones. Such sales are also authorized in the RMU zone
subject to the Conditional Use approval process in Section
7200.
3. OFF-PREMISE BEER & WINE SALES: Sales of wines, malt
liquors, and beers in unbroken original containers, to
consumers for off-premise consumption.
Such sales are authorized in the GC, HC, HI, RDD, and
CBD zones. Such sales are also authorized in the RMU zone
subject to the Conditional Use approval process in Section
7200.
4. OFF-PREMISE PACKAGE STORE SALES: Sales of distilled
liquors, wines, malt liquors, and beers in unbroken original
containers for off-premise consumption.
Such sales are authorized in the HC, RDD, and CBD
zones. Such sales are also authorized in the GC zone subject
to the Conditional Use process in Section 7200.
5. TEMPORARY SALES: Sales of alcoholic beverages not
exceeding four (4) days, for consumption on or off the
premises.
Such sales are authorized as permitted uses in the GC,
HC, HI, RDD, and CBD zones and also authorized subject to
the approval of the City Council in all other zones."
SECTION 15.
Section 3600 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to add the following:
"Alcoholic beverage sales subject to the provisions of Section
5400.
Convenience Stores "
SECTION 16.
The "Special Requirements" column for General Business signs
in Table 6741 of the Zoning Ordinance of the City of Wichita
Falls, Texas, is hereby amended to read as follows:
"Note 1"
SECTION 17.
The "Zone Permitted" column for Multi-Tenant signs limited to
80 ft. in area and 20 ft. in height is hereby amended to add
the following:
"LC"
