AN ORDINANCE CLOSING, VACATING, AND ABANDONING CHATEAU
COURT, A PUBLIC STREET IN THE CHATEAU ADDITION, WICHITA
FALLS, TEXAS, AND WAIVING SECTION 9B (j) OF APPENDIX A,
CITY OF WICHITA FALLS CODE OF ORDINANCES (COMPREHENSIVE
SUBDIVISION ORDINANCE NO. 2118) REQUIRING DRIVEWAYS OPENING
ON TO A PUBLIC STREET.
WHEREAS, the Planning & Zoning Commission has recommended the closure
of Chateau Court, subject to the retention of a utility easement, and also
recommended waiver of the requirement for driveways opening on to a public street;
and,
WHEREAS, the City Council of the City of Wichita Falls, Texas, deems
it advisable and in the public interest to close the street hereafter described
and waive the said requirements.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SLCTICIT 1. A tract of land being more commonly :mown as Chateau
Court, a dedicated street, lying in Chateau, an addition to the City of Wichita
Falls, Wichita County, Texas, said tract being more specifically described by
meZ:es and bounds as follows:
Beginning at the point of intersection of the west right-of-way line
of Chateau Court and the south right-of-way line of Midwestern Parkway, said
point being the most northerly northeast corner of Lot 1, Block 2, of said
Chateau;
Thence North 89° East 100.00 feet to the point of intersection of
said south right-of-way line of Midwestern Parkway, and the east right-of-way
line of Chateau Court, said point being the most northerly northwest corner of
Lot 21, of said Block 2, Chateau;
Thence along the right-of-way line of Chateau Court as follows:
Thence South 44° 20' West 28.28 feet to a point being the most
westerly northwest corner of said Lot 21, Block 2;
:hence South 00° 40' East 42.09 feet to a point lying in a curve, said
point being the southwest corner of said Lot 21, Block 2;
Thence along a 33.703 degree curve to the right, having a radius
of 170.00 feet, and a central angle of 29° 41' 05", a total distance of 88.08
feet to a point;
Thence South 00° 02' East 354.99 feet to a point being the northeast
corner of Lot 12, of said Block 2;
Thence South 89° 40' 31" West 170.60 feet to a point being the
northwest corner of Lot 8, of said Block 2;
Thence North 00° 23' West 34.89 feet to a point;
Thence North 33° 53' 19" West 92.62 feet to a point of curvature;
Thence along a 33.703 degree curve to the right, having a radius
of 170.00 feet, and a central angle of 102° 00' 42", a total distance of 302.67
feet to a point being the southeast corner of said Lot 1, Block 2;
Thence North 00° 40' West 53.61 feet to a point being the most easterly
northeast corner of said Lot 1, Block 2;
Thence North 45° 40' West 28.28 feet to the place of beginning and
containing 1.93 acres, less and except a 0.77 acre tract being more commonly kno- n
as Lots 1 and 2, Block 1, Chateau, an addition to the City of Wichita Falls,
Wichita County, Texas, said 0.77 acre tract being more specifically described by
metes and bounds as follows:
Beginning at a point being the northeast corner of said Lot 1, Block 1,
Chateau;
Thence South 00° 02' East 271.77 feet to a point being the southeast
corner of said Lot 2, Block 1;
Thence South 89° 40' 31" West 70.91 feet to a point being the southwest
corner of this tract;
Thence North 33° 53' 19" West 107.67 feet to a point of curvature;
Thence along a 47.746 degree curve to the right, having a radius of
120.00 feet, and a central angle of 138° 36' 31", a total distance of 291.00
feet to the place of beginning, leaving a net acreage of 1. 16 acres of land
lying within the right-of-way of Chateau Court;
be and the same is hereby closed, vacated, and
abandoned.
SECTION 2. The City of Wichita Falls hereby reserves the entire
right-of-way described in Section 1 as a utility easement for the purpose of
laying and maintaining all kind and character of utility lines including water,
gas, electric, telephone, television cable, power lines, and sanitary and storm
sewer.
SECTION 3. No portion of the street closed by SECTION 1 of this
ordinance shall be closed by a gate which restricts vehicular access to any
lots.
SECTION 4. This ordinance shall become effective upon the filing with
the Wichita County deed records, of a legal instrument, which is tied to the
land, and approved by the City Attorney, providing for access rights to all
abutting property owners, emergency and garbage collection vehicles on Chateau
Court, and holding the City harmless from any damages that may occur.

SECTION 5. Section 9B (j) of Appendix A, City of Wichita Falls
Code of Ordinance (Comprehensive Subdivision Ordinance 2118) requiring
driveways to open on to a public street is hereby waived for Chateau Subdivision,
Wichita Falls, Texas.
