A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS AUTHORIZING THE MAYOR TO EXECUTE A DEED FOR LOT
18-A, BLOCK 19, HILLCREST ADDITION TO THE WICHITA FALLS
AREA FOOD BANK, INC. ; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council authorized deeding the remainder
of Lots 18 through 21, Block 19, Hillcrest Addition to the
Wichita Falls Area Food Bank, Inc. , by Resolution No. 72-83 on
April 5, 1983; and,
WHEREAS, the agreement regarding the Food Bank which was
part of this resolution was executed; however, it has been
determined that the title to the property was never transferred.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. On behalf of the City of Wichita Falls, the
Mayor is hereby authorized to execute the attached deed for Lot
18-A, Block 19, Hillcrest Addition, Wichita Falls, Texas, to the
Wichita Falls Area Food Bank, Inc.
SECTION 2 . It is hereby officially found and determined
that the meeting at which this resolution was passed was open to
the public as required by law.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA S
THAT the City of Wichita Falls, Texas, a municipal
corporation, organized under the laws of the State of Texas, for
and in consideration of the sum of Ten ($10. 00) Dollars and other
good and valuable consideration, the receipt of which is hereby
acknowledged, has bargained, sold and conveyed, and by these
presents does grant, sell and convey unto the Wichita Falls Area
Food Bank, Inc. for operations as a food bank all the following
described real property situated, lying, and being located in the
County of Wichita, State of Texas, to-wit:
All of Lot 18-A, Block 19,
Hillcrest Addition to the City of
Wichita Falls.
TO HAVE AND TO HOLD the above-described premises unto the
said Wichita Falls Area Food Bank, Inc. , so long as said property
is operated as a Food Bank: provided that no temporary succession
not longer than six (6) consecutive months shall be deemed a
failure in such respect; and whenever Area Food Bank operations
shall cease to be carried on upon such premises, then and
thereupon this conveyance shall be null and void, and the said
land and premises shall absolutely revert without any necessity

for suit or re-entry to the Grantor herein, and no act or
omission on the part of the City shall be a waiver of the
operation or enforcement of such condition.
