RESOLUTION TO APPROVE GRANTING OF RIGHT-OF-
WAY EASEMENT TO THE CITY OF OLNEY, TEXAS FOR
A WATER LINE ACROSS CITY-OWNED LANDS AT LAKE
KICKAPOO, TEXAS
WHEREAS, the City of Wichita Falls on June 5, 1990 granted
an easement to the City of Olney for right-of-way in which the
City of Olney was to construct a water pipeline;
WHEREAS, since that date, the City of Wichita Falls has
undertaken certain modifications on the Lake Kickapoo dam, said
modifications affecting the location of the easement in which the
Olney pipeline is to be constructed;
WHEREAS, the City of Olney has redesigned the location of
their raw water pipeline to facilitate the Lake Kickapoo
modifications; and,
WHEREAS, the City Council of the City of Wichita Falls now
desires to grant a new right-of-way easement for the adjusted
location of the raw water pipeline, said easement to facilitate
the sale of water by the City of Wichita Falls from Lake Kickapoo
to the City of Olney.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The right-of-way easement to the City of Olney, Texas which
is document 72631 in Volume 501, page 485 of the Archer County
Court Records is hereby cancelled, and a new right-of-way
easement, is approved for use by the City of Olney. The City
Manager is authorized is execute the new easement for the City of
Wichita Falls .
