A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS ABANDONING THREE UTILITY EASEMENTS IN THE SIBLEY
TAYLOR ADDITION AND AUTHORIZING THE MAYOR TO EXECUTE A
QUIT CLAIM DEED; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Iglesia Bautista Emanuel is purchasing the church
property at 1100, 1004, and 1108 Terral Street; and,
WHEREAS, a request has been submitted to abandon the three
sanitary sewer easements on the property in order to allow for
expansion of the current facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. In consideration of the receipt of $637. 00 and
other valuable considerations, the Mayor is hereby authorized to
execute a quit claim deed to Manuel Davila and Templo de Albanza,
the current owners, conveying three sanitary sewer easements,
which are further described by the attached quit claim deed, the
same made a part hereof.
SECTION 2 . It is hereby officially found and determined
that the meeting at which this resolution was passed was open to
the public as required by law.

QUIT CLAIM DEED
STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA ) (
THAT the City of Wichita Falls, Texas, a municipal
corporation, hereinafter called Grantor, acting by and through
its duly authorized Mayor, for and in consideration of the sum of
Ten ($10. 00) Dollars and other good and valuable consideration,
in hand paid by Manuel Davila and Templo de Albanza, hereinafter
called Grantees, the receipt of which is herein acknowledged, has
granted, sold, conveyed, released, and forever quit claims unto
the said Grantees, all its right, title, and interest in and to
the following described real property situated in Wichita County,
Texas, to-wit:
Tract I
That certain right-of-way easement conveyed
to the City of Wichita Falls on April 5,
1927, and recorded in Volume 280, Page 345 of
the Wichita County deed records for the
construction and maintenance of a sewer line
across Lots 18, 19, 20, 21, 22 , and 23 , Block
24, Sibley Taylor Second Addition.
Tract II
A five foot easement conveyed to the City of
Wichita Falls in Volume 25, Page 347 of the
Wichita County plat records, being the West
five feet of Lot 20-A, Block 24, Sibley
Taylor Addition, and containing 828 square
feet, more or less.
Tract III
A fifteen foot sewer easement conveyed to the
City of Wichita Falls in Volume 25, Page 347
of the Wichita County plat records, and more
specifically described as follows:
COMMENCING at the Southwest corner of Lot 20-
A, Block 24, Sibley-Taylor Second Addition;
THENCE North 00° 51' West along the West line
of said Lot 20-A, 92. 0 feet to the center of
the 15. 0 foot easement and the beginning
thereof;
THENCE South 82° 51' 51. 0 feet along the
center of said easement to the end thereof
and containing 765 square feet of land, more
or less.
TO HAVE AND TO HOLD the above described premises, together
with all and singular the appurtenances thereto, in any way
belonging unto the said Grantees, their heirs, successors and
assigns.
As a part of the consideration for this conveyance, Grantees
agree to install a cleanout at the property line to allow the
City to service the sanitary sewer in the adjacent neighborhood,
and Grantees further accept ownership and maintenance of the
sewer line located within the property covered by this
conveyance.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a
municipal corporation of Wichita County, Texas, has caused this
instrument to be executed by its Mayor this the day of
December, 1993 .
