Res 163-93 10/19/1993RESOLUTION NO. 1 Q3-G3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS ABANDONING A UTILITY EASEMENT AND AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED TO TU ELECTRIC; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, TU Electric desires to expand their existing facilities at Kell and Austin Streets; however, such expansion has been hampered by an existing utility easement; and, WHEREAS, TU Electric has formally requested that the utility easement that was retained by the City of Wichita Falls in Ordinance No. 2165 now be abandoned. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. In consideration of the receipt of Ten ($10. 00) Dollars and other valuable considerations, the Mayor is hereby authorized to execute a quitclaim deed to Texas Utilities Electric Company, a Texas corporation, conveying a 22,850 square foot utility easement which was retained by the City when a portion of Chester Street was closed by Ordinance No. 2165 on May 10, 1965 and as further described by the attached quitclaim deed, the same made a part hereof for all purposes. SECTION 2 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. L1 City Cler QUIT CLAIM DEED STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF WICHITA ) ( THAT the City of Wichita Falls, Texas, a municipal corporation, hereinafter called Grantor, acting by and through its duly authorized Mayor, for and in consideration of the sum of Ten ($10. 00) Dollars and other good and valuable consideration, in hand paid by the Texas Utilities Electric Company, hereinafter called Grantee, the receipt of which is herein acknowledged, has granted, sold, conveyed, released, and forever quit claims unto the said Grantee, all its right, title, and interest in and to the following described real property situated in Wichita County, Texas, to-wit: That portion of Chester Street previously retained as a Utility Easement by Ordinance No. 2165 and being further described as follows: That portion of Chester Street from the East right-of- way line of Bluff Street to the West right-of-way line of Burnett Street, and lying between Block 31 of the I. A. Jalonick Addition to the City of Wichita Falls, and Block 1 of the Sibley-Taylor Addition to the City of Wichita Falls. TO HAVE AND TO HOLD the above described premises, together with all and singular the appurtenances thereto, in any way belonging unto the said Grantee, its successors and assigns. As a part of the consideration for this conveyance, Grantee agrees to install a cleanout at the property line to allow the City to service the sanitary sewer in the adjacent neighborhood, and Grantee further accepts ownership and maintenance of the sewer line located within the property covered by this conveyance.
