RESOLUTION TO APPROVE HOLLIDAY CREEK SANITARY
SEWER INTERCEPTOR CONTRACT TAKE-OVER
AGREEMENT
WHEREAS, the City of Wichita Falls has a contract with Conex
Construction Company for the construction of a major sanitary
sewer interceptor at an original contract price $2,455, 200 . 00;
WHEREAS, change orders during the process of the work has
increased the original contract to an amount of $2,485,428 .49;
WHEREAS, Conex Construction Company has defaulted on the
contract and left the job site, and the City has acted under the
provisions of the contract to terminate the right of the
contractor to proceed with the work;
WHEREAS, the contract was bonded by Fidelity and Casualty
Company of New York, and the bonding company intends to complete
the work; and,
WHEREAS, the Council has examined a proposed take-over
agreement whereby the bonding company will assume responsibility
and complete the uncompleted work.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The said take-over agreement between the City of Wichita
Falls and Fidelity and Casualty Company of New York for the
purposes stated is hereby approved, and the City Manager is
authorized to execute the same for the City of Wichita Falls.
