A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM
DEED TO JEFF AND THERESA CHAPPELL, CONVEYING A PORTION
OF A UTILITY EASEMENT; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS RESOLUTION WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City has received a request from Jeff and
Theresa Chappell to convey by quit claim deed a seven and one-
half foot portion of a dedicated utility easement at the rear of
2 Deanna Circle, Lot 29, of a replat of part of Block 7,
McKenzie Subdivision of the City of Wichita Falls, Texas; and,
WHEREAS, said portion of such dedicated utility easement
does not contain any existing utilities and is unnecessary for
future utility purposes; and,
WHEREAS, the City has caused the same to be appraised and
finds the fair market value to be Six Hundred Ninety One and
No/100 ($691. 00) Dollars.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS:
SECTION 1. In consideration of the receipt of the sum of
Six Hundred Ninety One and No/100 ($691.00) Dollars, the Mayor be
and is hereby authorized to execute a quit claim deed to Jeff and
Theresa Chappell, conveying a portion of a utility easement at
the rear of Lot 29, of a replat of part of Block 7, McKenzie
Subdivision in the City of Wichita Falls, and as further
described by the attached quit claim deed, the same made a part
hereof for all purposes.
SECTION 2 . It is hereby officially found and determined
that the meeting at which this resolutio. was passed was open to
the public as required by law.

QUIT CLAIM DEED
STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF WICHITA
That the City of Wichita Falls, Texas, a municipal
corporation, hereinafter called Grantor, acting by and through
its duly authorized Mayor, for and in consideration of the sum of
Six Hundred Ninety One and No/100 ($691. 00) Dollars and other
good and valuable consideration, in hand paid by Jeff and Theresa
Chappell, hereinafter called Grantee, the receipt whereof is
hereby acknowledged, has granted, sold, conveyed, released, and
forever quit claims unto the said Grantee, all its right, title,
and interest in and to the following described real property
situated in Wichita County, Texas, to-wit:
A 7. 5 foot wide portion of a 15 foot wide utility
easement in Lot 29, of a replat of Block 7, McKenzie
Subdivision, being more specifically identified in the
drawing attached hereto and incorporated herein for all
purposes.
SAVE AND EXCEPT that any easements are reserved for any and
all existing utilities as may be now located in said above-
described property, with the right of ingress and egress to same
for the purpose of operation, maintenance, or removal of such
utilities until such shall be abandoned or relocated.
TO HAVE AND TO HOLD the above-described premises, together
with all and singular the appurtenances thereto, except as
otherwise reserved, in any way belonging unto the said Grantee,
its successors and assigns, as above provided.
IN WITNESS WHEREOF, the City of Wichita Falls, Texas, a
municipal corporation of Wichita County, Texas, has caused this
instrument to be executed by its Mayor this the day of
June, 1993 .
