RESOLUTION TO AUTHORIZE FINAL PAYMENT TO
CONTRACTOR FOR PROJECT TO RELOCATE SANITARY
SEWER LINE ON EAST SCOTT STREET
WHEREAS, the City of Wichita Falls has a contract with
Scales Construction, Inc. for the relocation of a sanitary sewer
line on East Scott Street;
WHEREAS, the original contract price was $31,903 .20, and the
City has made previous payments in the amount of $25,841. 59,
leaving a contract amount of $6, 061. 61 due to the contractor;
WHEREAS, the contractor had a total of 70 authorized
calendar days to complete the work and used 76 days for the work;
and,
WHEREAS, the contractor is assessed liquidated damages at
the rate of $120. 00 per day for each of the six additional days
required to complete the work, a total liquidated damages of
720. 00 which is deducted from the amount due the contractor,
leaving a final payment of $5, 341. 61.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The project to relocate a sanitary sewer line on East Scott
Street is hereby accepted as complete, and the City Manager is
authorized to make a final payment of $5, 341. 61 to the
contractor.
