ORDINANCE GRANTING AUTHORITY TO
THE BETHANIA REGIONAL HEALTH CARE
CENTER TO LAY AN UNDERGROUND CONDUIT
IN AN ALLEY RIGHT-OF-WAY
WHEREAS, the Bethania Regional Health Care Center owns buildings
on both sides of the alley right-of-way between Tenth and Eleventh Streets
and west of Grace Street;
WHEREAS, Bethania desires to construct an underground conduit
for a cable to connect the Data Processing Center with the main hospital
operating area; and,
WHEREAS, Bethania has agreed to certain stipulations by the City
of Wichita Falls for the construction of the underground conduit, and a copy
of the letter of agreement is attached to this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. The Bethania Regional Health Care Center is hereby
granted the right and authority to construct, maintain and operate a 10-inch
cable conduit beneath the alley right-of-way between Tenth and Eleventh
Streets and west of Grace Street.
SECTION 2. It shall be the duty of said Bethania Regional Health
Care Center at all times to maintain said cable conduit at its own expense.
If at any time in the future some public use of such right-of-way makes it
necessary that the said line be relocated or removed, such relocation or
removal shall be done at the sole cost and expense of Bethania Hospital.
SECTION 3. Whenever any work is being done on the construction
or maintenance of said conduit, the Bethania Regional Health Care Center
shall take all necessary and proper precaution to protect the public from
damage, and said Bethania shall save the City of Wichita Falls harmless
from all damages, or claims for damage, resulting from the construction,

maintenance and operation of said conduit.
SECTION 4. The right and authority hereby granted is for a
period of twenty-five years from the date of this ordinance.
SECTION 5. The fact that the Bethania Regional Health Care
Center has just completed a major expansion and is now ready to install
the cable conduit to support the computer operations of the hospital, the
laying of this cable conduit constitutes an emergency, and this ordinance
is passed as an emergency measure and shall take effect immediately after
its passage.

Dear Mr. Bonnett:
Bethania Regional Health Care Center desires to install a computer cable
conduit in the alley between 10th and 11th Streets and west of Grace Street.
The conduit will be installed below the surface of the alley, but above an
existing sewer line in the alley. We understand and agree to your conditions
that the cable conduit must be encased in concrete; the cable location must
be marked on each side of the alley with a sign; and diagonal cross hatching
must be placed on the asphalt between the two signs.
Bethania Regional Health Care Center also agrees to fully indemnify and save
whole and harmless the City of Wichita Falls from all costs or damages that
may arise from any work of any character by the City of Wichita Falls to the
existing alley surface or any utility now present or present in the future
below the surface of the alley.
We ask that the staff of the City of Wichita Falls seek the approval of the
City Council for the installation of the cable conduit.
