Ord 044-86 6/3/1986 ORDINANCE NO. 44-86 AN ORDINANCE CLOSING, VACATING, AND ABANDONING A PORTION OF A NORTH-SOUTH ALLEY AND A RESERVED ACCESS STRIP IN BLOCK 118, HIGHLAND ADDITION, WICHITA FALLS, TEXAS, AND RETAINING A UTILITY EASEMENT WHEREAS, the Board of Aldermen reserved a 35 foot wide east-west access strip on Lot 14, Blk 118, Highland Addition, on October 22, 1956, as a condition of closure of the south 115 feet of the north-south alley; and, WHEREAS, a twenty foot wide east-west alley along with a ten foot wide access easement is now being dedicated; and, WHEREAS, the Planning & Zoning Commission has recommended the closure of said reserved access strip, along with a 65 foot portion of the north-south alley. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The 35 foot wide east-west reserved access strip and a portion of the 20 foot wide north-south alley, more specifically described as follows: BEGINNING at an iron rod in the East line of Lot 15, Block 118 which bears S 07° 20 ' W a distance of 20. 0 feet from the Northeast corner of said Lot 15 ; THENCE S 07° 20 ' W a distance of 30.0 feet to the Southeast corner of said Lot 15 ; THENCE West a distance of 149 .5 feet to a point for the Southwest corner of said Lot 15 ; THENCE S 07° 15 ' W with the West line of Lot 14 a distance of 35 .0 feet to a point; THENCE East a distance of 169 . 2 feet to a point ; THENCE N 07° 20' E a distance of 65 .0 feet to a point; THENCE West a distance of 20. 2 feet to the PLACE OF BEGINNING, is hereby closed, vacated, and abandoned. SECTION 2. The City of Wichita Falls hereby retains a utility easement on the portion of the 20 foot wide north-south alley closed in Section 1, for the -2- purpose of laying and maintaining all kind and character of utility lines including water, gas, electric, telephone cable, power lines, and sanitary and storm sewer. SECTION 3. This closure shall become effective upon the filing of a plat of Lot 8-C, Block 118, Highland Addition, dedicating the 20 foot wide east-west alley along with a 10 foot wide access easement, within one (1) year of the passage of the ordinance.
