AN ORDINANCE EXTENDING THE CITY LIMITS OF THE
CITY OF WICHITA FALLS, BY ANNEXING CERTAIN
TRACTS OF LAND ADJACENT TO THE TERRITORIAL
LIMITS OF THE CITY OF WICHITA FALLS, TEXAS,
WHICH TRACTS OF LAND AND SERVICE PLAN FOR SUCH
TRACTS OF LAND ARE DESCRIBED IN THIS ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS THAT:
SECTION 1. TRACT DESCRIPTIONS: The following tracts of
land located in Wichita County, Texas, be and the same are hereby
ordered to be annexed and to be included within the corporate
limits of the City of Wichita Falls, Texas, and the corporate
limits be extended so as to include said tracts of land in
Wichita County, Texas, the same being more specifically described
as follows:
TRACT 1
A tract of land out of Block 12, Denton County School Lands,
League 2, Abstract 57, Wichita County, Texas; and being more
specifically described by metes and bounds-as follows:
Beginning at a point which lies 200 feet West of the west right-
of-way line of Gregg Road, said point bears North 88 degrees 23 '
East 654.3 feet, North 00 degrees 01 ' West 335.0 feet, South 89
degrees 58 ' East 1,721.0 feet and North 00 degrees 10 ' East
1, 220.0 feet from the southwest corner of said Block 12, Denton
County School Lands, League 2, Abstract 57;
Thence South 00 degrees 10' West along a line that is 200 feet
west of and parallel to the west right-of-way line of Gregg Road
1,220. 0 feet;
Thence North 89 degrees 58 ' West 1721.0 feet to a point in a
fence line for the southwest corner of this tract;
Thence along said fence line North 00 degrees 13 ' West 1220.0
feet to a point for corner of this tract,
Thence South 89 degrees 58 ' East 1729. 2 feet to the place of
beginning and containing 48.3 acres, more or less.
TRACT 2
A tract of land out of Block 11, Denton County School Land,
League 2, Wichita County, Texas; and being more specifically
described by metes and bounds as follows:
Beginning at the southwest corner of Hill & Hill Heights, Section
1, Unit 1;
Thence South 00 degrees 04 ' East 698. 15 feet to an iron rod set
150. 0 feet from the center of the Fort Worth and Denver Railroad;
Thence parallel with and 150. 0 feet at right angles from the Fort
Worth and Denver Railroad, North 57 degrees 01 ' 12" East 850. 3
feet to a point set for the southeast corner;
Thence North 01 degrees 10 ' East 262. 06 to a point for the
northeast corner of this tract;
Thence North 87 degrees 49 ' West 138 . 62 feet to a point for an
interior corner of this tract, and the southwest corner of Lot 5,
Block 1, Hill & Hill Heights, Section 2, Unit 1;
Thence South 02 degrees 11 ' West 45.00 feet to a point set for an
interior corner of this tract;
Thence North 87 degrees 49 ' west 200 . 00 feet to a point set for a
corner;
Thence North 02 degrees 11 ' East along the west line of a 20 '
wide alley 5. 00 feet to a point for an interior corner of this
tract;
Thence North 87 degrees 49 ' West along the south line of a 20 '
wide alley 380. 80 feet to the point of beginning and containing
7. 66 acres, more or less.
SECTION 2. 0 . SERVICE PLAN: This service plan for
annexation of property to the City of Wichita Falls, Texas, has
been prepared by the Planning Department of the City of Wichita
Falls in conformance with the requirements of Article 970a,
Section 10, Vernon' s Texas Civil Statutes.
SECTION 2. 1: SERVICES TO BE PROVIDED WITHIN SIXTY ( 60)
DAYS. A. Police Protection. Police protection will be provided
by the Wichita Falls Police Department within sixty ( 60) days of
the effective date of annexation, using existing personnel and
equipment.
B . Fire Protection. Fire protection will be provided by
the Wichita Falls Fire Department within sixty ( 60) days of the
effective date of annexation using existing personnel and
equipment. Primary service will be provided by Fire Station No.
6, which has a response time of 2 .0 minutes. Back-up service
will be provided by Station No. 8 with a response time of 3 . 0
minutes. Secondary back-up will be provided by Station No. 5
with a response of 3 . 5 minutes.
C. Solid Waste Collection. Solid waste collection shall
be provided by the City of Wichita Falls Sanitation Division in
accordance with Chapter 17: "Garbage, Refuse, Rubbish and
Trash," Code of Ordinances, City of Wichita Falls within sixty
(60) days of the effective date of annexation.
D. Maintenance of Water and Waste Water Facilities.
Maintenance of water and waste water facilities shall be the
responsibility of the developer for a period of one ( 1) year
following acceptances of said facilities by the city. Following
the one ( 1) year period of obligation of the developer, the City
of Wichita Falls Public Utilities Department shall assume all
responsibility for maintenance of water and waste water
facilities from thence forward, in accordance with Chapter 32:
"Water and Sewers," Code of Ordinances, City of Wichita Falls.
E. Maintenance of Roads, Streets and Alleys. Maintenance
of roads, streets and alleys shall be the responsibility of the
developer for a period of one (1) year following the acceptance
of said facilities by the city. Following the one ( 1) year
period of obligation of the developer, the City of Wichita Falls
Public Works Department shall assume all responsibility for
maintenance of the roads, streets, and alleys from thence
forward, in accordance with Chapter 27 : "Streets and Sidewalks,"
Code of Ordinances, City of Wichita Falls.
SECTION 2. 2: CAPITAL IMPROVEMENTS. All capital
improvements including, but not limited to streets, alleys,
water service lines, waste water service lines, and fire
hydrants, shall be constructed by the developers of each tract in
accordance with Appendix A "Comprehensive Subdivision Ordinance,"
Code of Ordinances, City of Wichita Falls.
SECTION 3 .0: PUBLIC HEARINGS. In conformity with
Section 6 of Article 970a of the Revised Civil Statutes of Texas,
before these annexation proceedings were instituted, public
hearings were held July 9, 1986 and July 15, 1986 to provide an
opportunity for all interested persons to be heard; these
hearings were held not more than forty ( 40) days nor less than
twenty ( 20) days prior to the institution of these annexation
proceedings. Notices of the public hearings were published once
each in the Wichita Falls Times/Records News not more than twenty
( 20) days nor less than ten ( 10) days prior to each hearing.
SECTION 4.0: INTRODUCTION OF ORDINANCE. In conformity
with Section 3-A of the amended charter of the City of Wichita
Falls, Texas, this ordinance was introduced on the 5th day of
August, 1986 and published in a newspaper of general circulation
in the City of Wichita Falls, Texas, to wit, the Wichita Falls
Record News, one ( 1) time, on the 8th day of August, 1986 and
seven (7) days having elapsed since such publication, this
ordinance is finally passed and approved this the 19th day of
August, 1986.
SECTION 5. 0: EMERGENCY PROVISION. Because of the fact
that construction is taking place in these areas which will
require city services as soon as possible, this ordinance is
declared to be an emergency measure, and will become effective
upon its passage.
