ORDINANCE WAIVING SECTION 27-29 OF THE CODE
OF ORDINANCES CONCERNING SIDEWALK REQUIREMENTS
ALONG A LARGE PARCEL OF COMMERCIAL PROPERTY
HAVING A STREET ADDRESS OF 2117 WINANN AND
DESCRIBED AS LOT 6A, BLOCK 5, RIVERCREST PARK
WHEREAS, H. S. Mahler of Mahler Oil Company has requested that the
requirement that sidewalks to be constructed on all streets abutting a commercial
or industrial lot be waived; and,
WHEREAS, there are no other sidewalks on either side of the street
for the entire length of Winann; and,
WHEREAS, the sidewalk will never be connected as it serves an old already
established area with no sidewalks; and,
WHEREAS, the staff recommends that the waiver be granted because it is
not a school route and is an undeveloped commercial area;
WHEREAS, the City Council finds the circumstances exceptional and that the
requirements of Section 27-29 of the Code of Ordinances concerning the sidewalk
should be waived.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, THAT:
The requirements of Section 27-29 of the Code of Ordinances requiring a
sidewalk when constructing or remodeling buildings be waived.
