Ord 078-86 9/16/1986 ORDINANCE NO. 78-86
ORDINANCE AUTHORIZING THE CITY MANAGER TO
APPROVE AND EXECUTE CHANGE ORDERS TO CITY
CONTRACTS UNDER CERTAIN CIRCUMSTANCES.
WHEREAS, the City of Wichita Falls enters into numerous
construction contracts; and,
WHEREAS, it is not unusual for changes to be required in
these contracts as unforeseen situations arise; and,
WHEREAS, at times such changes must be approved rapidly
in order to avoid construction delays or to protect existing
City investments; and,
WHEREAS, Art. 2368a, Revised Civil Statutes of Texas,
authorizes the City Council to grant authority of an administra-
tive official to approve change orders of $15 , 000 or less.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City Manager is hereby authorized to approve
and execute change orders to City contracts where the amount
of increase or decrease in contract price is less than $5, 000
and where the overall scope of the project under contract will
not be materially affected.
SECTION 2. The City Manager is hereby authorized to approve
and execute change orders to City contracts where the increase
or decrease in contract price is $5, 000 to $15, 000 where an
immediate necessity exists for the change order in order to
avoid damage or destruction to existing City improvements or
to improvements which have already been constructed as a part
of the project under construction.
SECTION 3. When a change order is so made, it will be
reported to City Council at its next meeting.
