RESOLUTION NO. tIL -
RESOLUTION ACCEPT PRISON SEWER SYSTEM
PROJECT AS COMPLETE AND AUTHORIZE FINAL
PAYMENT TO CONTRACTOR
WHEREAS, the City entered a contract with Bowles
Construction Company, Inc . for construction of a sanitary
sewer system to serve the new State Prison on Huntington Lane;
WHEREAS, the original contract price of $722, 753 . 80 was
increased by three (3) approved change orders to $725, 314 . 78;
WHEREAS, the City has previously paid the contractor an
amount of $710, 808 .48, leaving an amount of $14, 506 . 30 due to
the contractor;
WHEREAS, the contractor has been assessed six (6) days
liquidated damage at $240 . 00 per day for a total assessment of
1, 440 . 00, said amount to be deducted from the amount due the
contractor, leaving a final payment of $13 , 066 . 30;
WHEREAS, the staff has inspected the project and found
that the project meets specifications; and,
WHEREAS, the Council now desires to accept the project as
complete and to make final payment to the contractor.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
The project to construct a sanitary sewer system to serve
the new State Prison is hereby accepted as complete, and the
City Manager is authorized to make a final payment to Bowles
Construction Company, Inc . in the amount of $13 , 066 . 30 .
