I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH BUCHANAN CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF THE MULTI-PURPOSE EVENTS CENTER AGRICULTURAL COMPLEX FOR A CONTRACT AMOUNT OF 3, 142,437, THE SAME REPRESENTING THE CONSTRUCTION COSTS FOR SAID CENTER, INCLUDING THE BASE BID AND ALTERNATIVES 1 THROUGH 4; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS RESOLUTION WAS DISCUSSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS: SECTION 1. That the Mayor be and is hereby authorized to execute a contract with Buchanan Construction Company for the construction of the Multi-Purpose Events Center Agricultural Complex, for a contract amount of $3, 142,437, the same representing the construction costs for said center, including the base bid and alternatives 1 through 4. SECTION 2 . That a copy of said contract document is attached hereto as Exhibit A and made a part of this resolution for all purposes. SECTION 3 . It is hereby officially found and determined that the meeting at which this resolution was passed was open to the public as required by law. ARTICLE 5 PROGRESS PAYMENTS 5.1 Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for Payment issued by the Architect, the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided below and elsewhere in the Contract Documents. 5.2 The period covered by each Application for Payment shall be one calendar month ending on the last day of the month,or as follows: Each payment shall be submitted to the Architect by the Twenty-Fifth (25th) of each month, for payment by the Fifth (5th) of the following month. 5.3 Provided an Application f r Payment is received by the Architect not later than the Twenty-Fifth (25th)day of a month.the Owner shall make payment to the Contractor not later than the Fifth (5 t: ). day of theFollowing month.
