RESOLUTION TO APPROVE SEVENTH AMENDMENT TO
WATER PURCHASE CONTRACT WITH FRIBERG-COOPER
WATER SUPPLY CORPORATION
WHEREAS, the City of Wichita Falls and Friberg-Cooper Water
Supply Water Cooperation entered into a Water Purchase Contract
dated June 15, 1979, and there have been six previously agreed
amendments to the contract;
WHEREAS, Section 1 . 8 of the existing contract restricts the
amount of water to be taken by Friberg-Cooper from the City to
not more than 100, 000 gallons per day;
WHEREAS, Friberg-Cooper desires to increase the amount of
water available from Wichita Falls to 150, 000 gallons per day in
order to meet the minimum requirements of State law and to
facilitate the use of certain improvements being made in the
storage and distribution system of the Corporation;
WHEREAS, the City of Wichita Falls desires to make certain
amendments in Section 5 . 0 of the contract as it pertains to the
Aircraft Potential Zones and noise zones of Sheppard Air Force
Base; and,
WHEREAS, the Council has examined and desires to approve a
contract amendment for the purposes stated.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
That certain contract amendment to amend Sections 1 . 8 and
5 . 0 of the Water Purchase Contract between the City of Wichita
Falls and Friberg-Cooper Water Supply Corporation is hereby
approved, and the City Manager is authorized t execute the same
for the City of Wichita Falls .
